Subject: New Agenda item for discussion in the Meeting of the National Anomaly Committee.
The Hon'ble High Court of Madras in its order dated 10.9.2009 in Writ Petition No.21367/2004 (grievances of Drivers and Artisans in the Postal Department with regard to anomaly in fixing pay since 4th Central Pay Commission followed by directorate dated15.12.2010 in Contempt Petition No.1371/2010 has directed that the matter may be referred to the National Anomaly Committee for its consideration and passing appropriate orders. Accordingly, Department of Posts has forwarded detailed Agenda Note on examination of the Claim of the cadre of Drivers deployed in Department of Posts for grant of pay scale equal to that of Postal Assistants working in the same Department in pursuance to direction of Hon'ble High Court of Madras.
'In view of the position mentioned above, Secretary (P) in her capacity as the Chairperson of the Anomaly Committee has approved inclusion of the matter in the Agenda of the National Anomaly Committee. It is likely that this issue will be discussed in the next meeting of the National Anomaly Committee to be held in near future. A copy of the Agenda Note forwarded by the Department of Posts is enclosed for information and perusal please.

AGENDA NOTE
ISSUE :
EXAMINATIN OF THE CLAIM OF THE CADRE OF DRIVERS DEPLOYED IN DEPARTMENT OF POSTS FOR PAY SCALE EQUAL TO THAT OF POSTAL ASSISTANTS WORKING IN THE SAME DEPARTMENT IN PURSUANCE TO DIRECTIONS OF HON'BLE HIGH COURT OF MADRAS IN JUDGEMENT DATED 10.09.2009 IN WP NO.21367/2004 FOLLOWED BY DIRECTIONS DATED 15.12.2010 IN CONTEMPT PETITION NO.1371/2010
GROUNDS :
1. Consequent upon implementation of 5th CPC recommendations, the cadre of Drivers deployed in Department of Posts in Mail Motor Services and other subordinate offices was placed in the scale of Rs.3050-4590. Their earlier scale as per 4th CPC recommendation was Rs.950-1500.
2. The Association representing the Drivers and Artisans submitted representation dated 20.08.2001 and 12.12.2001 to the Department of Posts that their cadre placed at the minimum of the pay scale equivalent to Postal Assistants in 1st CPC, 2nd CPC and 3rd CPC. Their argument was that in the 4th CPC they were given the minimum of Rs.950-1500 whereas the Postal Assistants cadre was given Rs.975-1660. While implementing the 5th Pay Commission recommendations, they were placed in the scale of Rs.3050-4590 whereas Postal Assistants were given the scale of Rs.4000-6000 and further stated that there is a genuine anomaly while fixing the scale of Drivers. They also represented that the Postman cadre, which was always kept below their pay scale; was given a jump and equated with their scale of pay the 5th Pay Commission recommendations. The other argument was that they have to possess Heavy Vehicle License and to do exchange of bags containing valuables, cash, etc. and represented to the Hon'ble Minister for Communications for bringing the parity with Postal Assistants. All these submissions were examined and the Association was informed that the Central Pay Commission submitted the recommendations on pay scale after taking into account the specific requirements for each category of posts in terms of educational qualification, skill required, arduous nature of work undertaken and based on the composite view of the matter & also that the Drivers are part of common cadres in Central Government the question of any isolated examination of their pay scale confining to Department of Posts alone did not arise. This communication was sent to the Association on 07.02.2002.
3. The Association filed an OA No.148/2003 before the Hon'ble Central Administrative Tribunal at Madras, which was dismissed observing that no sufficient material has been placed before them to record a specific finding as to whether there had been arbitrary, discriminatory and hostile discrimination made to the applicants in granting the pay scale. In no circumstances, the case of the Postal Assistants could be treated at par with Drivers.
4. Aggreved by the CAT order, the Association further filed Writ Petition No.21367/2004 in the Hon'ble High Court at Madrs. The Court after examining the affidavit filed by the Department observed in Para No.8 of their judgement that "it is an admitted case that upto the Third Pay Commission, the pay of Drivers was equal to that of Postal Assistants. In the Fifth Pay Commission, the difference in the pay scale of Postal Assistants and Drivers was Rs.950/-. The case of the petitioners is that, their duties are more arduous; they have to carry insured bags registered post, parcel, speed posts and letters bags from various post offices situated in remote villages and drive through ruddy roads to catch the trains. The only reason given for fixing a higher pay to Postal Assistants is that they possess 10th standard qualification and having knowledge in computer. Though learned counsel appearing for the respondents submitted that common categories are common to all Central Government Departments and their recruitment rules and pay scales are also similar, yet the pay scale of postal Assistants and Drivers are different. The Drivers working in the Delhi Judicial service are getting a higher scale of pay. When the Central Government has prescribed 10th Standard as the qualification for Postal Assistants, the same qualification should have been fixed for the Drivers also, especially when the Drivers were getting an equal pay till the Fourth Pay Commission. This shows that definitely there is discrimination in pay scales among Postal Assistants and Drivers, ............In this case admittedly the scale of pay of Postal Assistants and Drivers was the same till the Fourth Pay Commission and thereafter parity in pay had arisen. This shows that the decision of the Government in fixing the pay scales of Postal Assistants and Drivers are patently irrational, unjust and prejudicial to a section of employees. Therefore we consider it appropriate to set aside the order under challenge and dispose of the writ petition with a direction to the respondents to refer the matter to the Anomaly Committee for its consideration and passing appropriate orders within a period of three months from the date of receipt of a copy of this order and if necessary, to afford an opportunity of hearing to the petitioners. ........."
5. On receipt of this judgement, the Department sought extension of time for its examination till 30.06.2010. The Hon'ble High Court at Madras did not specifically direct for placing the matter before National Anomaly Committee. By the time of receipt of the Judgement, the Department had already constituted its Anomaly Committee for sorting out the anomalies that arose due to implementation of 6th Pay Commission recommendations pertaining to the Department. Since the parity had been sought with a cadre of Postal Assistants, which is exclusively specific to the Department, the Departmental Anomaly Committee (DAC) chose to examine this in its meetings held on 05.02.2010 and also on 16.04.2010 after giving an opportunity to the Association for presenting their case. The DAC observed that the parity sought is not falling under the ambit of definition of the term 'anomaly' defined by DOPT but recommended for taking u the case with Nodal Ministry for placing the Drivers on par with Postman Grade by giving Grade Pay of Rs.2000 outside the purview of Anomaly Committee.
6. The proposal sent by Department of Posts to Department of Expenditure, Ministry of Finance through Department of Personnel & Training for placing the Drivers on par with Postman Grade by giving Grade pay of Rs.2000 did not find favour with by Ministry of Finance, Department of Expenditure. This was also conveyed to the Association. The Association filed a Contempt Petition in the Hon'ble High Court of Chennai alleging that there was a wanton disobedience in implementation of the order of the Hon'ble High Court. The Department filed a detailed affidavit rebutting their contentions raised in the Contempt directing the Additional Solicitor General in High Court for writing to the concerned Ministry for convening the meeting National Anomaly Committee for examination of the issue raised by the Association for bringing parity with the cadre of Postal Assistants in the Department of Posts.
7. Therefore, the agenda before the National Anomaly Committee is for examination of the issue of providing Grade Pay of Rs.2400 to the Drivers deployed in Department of Posts at the initial entry on par with Postal Assistants.

Sub: - Counting of Past Services rendered by RTP for promotion.
We have submitted a memorandum to Honble Minister of State for communication & IT on 29.12.2010 in which we sought settlement of R.T.P issue hanging over the decades with the new dimension.
(i) The Department has regularized the past services of RTP for those deputed to APS with retrospective effect based on Supreme Court orders. Resultantly, the seniors to those officials are deprived of their seniority, promotional benefits etc. As per the Rules, the seniority should be decided based on the merit in the recruitment list. All the seniors should be stepped up at par with their juniors deputed APS. This is a new area, developed recently.
(ii) There are certain officials approached CAT like Kerala whose RTP services were earlier taken for all purposes. We are demanding the same to the similarly situated persons.
(iii) There is every justification for regularising their RTP service for which we cited many cases in the past through our correspondences.
Based on our submission, the Department has now called for details from all circles vide its letter No.44-1/2011 - SPN dt. 13.01.2011. The Copy of the letter is enclosed.
All circle secretaries are requested to approach the circle administration and see the required particulars are submitted favourably.
We should not leave any stone unturned in the case of counting of past services to the ex RTPs.
Let us move in this direction.

CADRE REVIEW
A formal meeting for discussion of the cadre review proposal was held on 27.12.2010. There was no concrete decision arrived in the meeting but there was more progress. The following are only the gist of proposals.
1. Postman: - The present establishment inexistence in this cadre is as follows

At present, there is no supervisory cadre in existence for Postman. Earlier Mail overseers, Sorting Postmen etc were called as LSG and there after it lost significance after introducing TBOP/BCR promotions.
It is proposed by the staff side to provide three promotional layers to this cadre by keeping 70% in basic, 15% in the first, 10% in the second and 5% in the third promotions. It is suggested that out of four postmen, one of the post may be identified to supervise the other three postmen in ensuring 100% articles taking for delivery and remarks in the return apart from his delivery work. Similarly the postman entrusted with Data work for preparing delivery slip, taking returns etc may be provided to the status of next promotion layer and similarly the existing Mail overseers etc may be brought to the third promotional layer.
Since the cadre review pertains only to improve the promotional posts and not to review the pay scales, the pay band may be decided like 2000, 2400, 2800 & 4200 for basic, I, II & III Grades retrospectively.
2. Multi Skilled Staff (Group D)
There is 37757 Multi skilled staff in existence in the Department out of which 17700 in Postal and 14000 in RMS and the remaining are working in administrative offices.
Since the MTS are not getting any II & III MACP promotions and even some are not getting MACP I also, special attention is required. It is suggested to form three layers of Promotion like basis 70, 1st 15, 2nd 10 & third 5% of posts. It is suggested that the MTS assisting Treasury & Sub Accounts may be identified as higher posts. Similarly van attendant, Jamedar in RM and Record Keeper, Chowkidar etc may be identified as higher posts for providing promotions. Since MTS (Group ‘D’) is a common cadre for all Central Government employees, the identification of area and responsibility becomes a must for consideration of care review proposals.

As on date, the total number of supervisory posts works out only 12.35% it is suggested that all the single handed & double handed post offices may be identified as LSG Posts (Single handed offices 11395 & Double handed offices 6719). Since the elevation of pay band with Grade pay Rs. 4200/- is not immediately possible to LSG since it has long process and left the decision with nodal ministries, the present LSG posts 6989 posts may be merged with HSG II cadre. (For example 2899 LSG offices plus 3732 Triple handed post offices & plus other LSG Posts). Similarly the present HSG II & HSG I posts shall be amalgamated. There will be no change of Grade pay in any cadre since it will not come under the jurisdiction of cadre review.
It is suggested that the nomenclature of existing LSG, HSG-II & HSG-I shall be revised as Supervisor/Manager, Senior Manager/ Supervisor, Chief Manager/Supervisor respectively. It is further suggested to convert the HSG-I as Gazetted as if equal to the present status of Asst. Supdt. of POs.
Whatever be the increase in the number of Supervisory post, it will have simultaneous reflection in the Post master’s cadre also.
PO & RMS Accountant, System Administrators Marketing Executive & others
After identifying the number of Grade I, I & III posts from the Postal Assistants, separate cadre for PO & RMS Accountants, Systems Assistants, Marketing Executive will be carved out from the promotional posts and declare the posts as promotional posts to Postal Assistants.
(i) The PO & RMS Accounts qualified officials will be placed in Rs. 2800/- grade pay and on qualifying they may be engaged in accounts branch. A separate promotional avenue can be carved out for APM Accounts from the existing LSG, HSG II & HSG I Posts.
(ii) Marketing Executive will be placed in Rs.2800/- Grade pay and a separate cadre will be explored in higher promotional posts.
(iii) System Administrators will also be carved out similarly to this. However, it is suggested that in respect of System Administrators, they may be placed in the Grade pay of Rs. 4200/- as if available in other Governmental organization. PMAs will be brought under the category of System Assistant.
(iv) Similarly there are 300 DOPLI and they may be placed in the Grade Pay of Rs. 4200/-
In respect of RMS, What is the proportion maintained in Postal Assistant cadre in higher posts in the postal, that will be maintained.
Circle office staff
In respect of circle office there are 2400 officials working and at present there is only one promotion of section supervisor with Grade Pay of Rs. 2800/- available.
It is proposed to form II layer of promotion as deputy office superintendent with Grade Pay of Rs.4200/- and elevate the office superintendent with Grade Pay of Rs.4600/- Similarly another layer of Director with grade pay of Rs,4800 may be formed. The Percentage proposed is 50 + 20 + 15+ 10 + 5. There are 59 regional offices in which, it is suggested to upgrade the office supervisors. Similarly all PLI section officers may be elevated to the status of office superintendent.
SBCO staff
Total staff is 4100. There is no HSG II at present. It is suggested to provide four layers of promotions with the ratio of 50:20:20; 5: 5. The SBCO in charge of All Gazetted HPOs (116) may be converted to HSG I. There are 442 divisions and all the in charge of such divisional head quarters may be considered for HSG II. It is further suggested that the in charge of SBCO having up to 50,000 entries may be converted to LSG, above 50,000 up to 100000 may be to HSG II and above 1 lakh, it will be HSG I, Similarly all working in (PWCs/ICOs shall be placed in promotional posts.
Matching Savings
Official side proposed to accept closure/ merger of 3000 single handed post offices/ RMS offices as matching savings in urban areas which will be decided on the following grounds:
i. Offices having less than five hours work load (excluding sub accounts work)
ii. Post offices situated within 2.5 kilometers.
iii. The personnel relieved due to the closure/merger will be accommodated in the single/ double handed offices where work load justify for further augmentation.
The staff side seeks time to discuss on matching savings among them and to form a joint proposal on all the above discussed items.

Please note that the above proposals are not accepted totally and it were in the discussion stages only. A broad consensus and discussions are required to improve many of the items mentioned above. Staff side will sit shortly and discuss the above and submit its proposal shortly. The next formal meeting will be held on 22.1.2011 at 11 hours to finalize the proposal.
All are requested to offer their comments on this to have further study and improvement of our proposals.

Office Memorandum
Subject: Consolidated guidelines on cadre review of Central Group 'A' Services.
The undersigned is directed to say that provisions governing the process of cadre review of Central Group 'A' Services are contained in various Office Memoranda issued by the Department of Personnel and Training and the Department of Expenditure. As a part of this Department's endeavour to keep the personnel policies relevant to current and future needs, these provisions have been reviewed in consultation with various stakeholders and it has been decided to issue a consolidated and revised set of guidelines on cadre review. The revised guidelines are given below. Besides, the broad issues concerning cadre review have been elaborated in the revised Monograph on Cadre Review of Central Group 'A' Services enclosed herewith. The list of existing Central Group 'A' Services is at Annex-I.
2. Formulation of Proposal
(i) The proposal would be formulated, to the extent possible, in consultation with the representatives of service association (s). While drafting the proposal, all issues like expected changes in the Organization's activities, automation, amendment in the business processes, recruitment planning, plugging the skill gaps, cadre structure, career progression, financial implications etc. must be analyzed and made part of the proposal. These issues and their impact on cadre structure have been discussed in Section-5 and Section-6 of the Monograph.
(ii) Full functional justification for each creation of post/upgradation should be given. A job evaluation exercise may be undertaken for each category of posts so as to ensure that different grades are assigned corresponding level of functions and
responsibilities.
(iii) It may be ensured that the cadre review would not have an adverse impact on the feeder grade.
3. Reference to Department of Personnel and Training/Department of
Expenditure
(i) The proposal should be referred to Department of Personnel and Training with the approval of Integrated Finance Division and the Minister in charge.
(ii) The Cadre Controlling Authority would also give a certificate that there is no Court Case pending having a bearing on the cadre review.
(iii) The name (s) of contact officer (s) for further/additional information may be
clearly indicated in the reference.
(iv) The proposal should be examined vis-à-vis the checklist given in Section-6
of the Monograph to ensure that the proposal is complete in all respect.
4. Financial Implications
(i) The proposal having additional financial implications would be entertained
strictly on functional considerations like consistent increase in workload,
horizontal expansion in activities etc.
(ii) While calculating the additional expenditure, the impact of Non-Functional
Upgradation may be taken into account. The calculation sheet must be enclosed
with the proposal.
5. Procedure for cadre review
(i) Every cadre should be reviewed once every five years. The review should be first carried out by the Cadre Controlling Authority, preferably in consultation with the representatives of the service/cadre in question. However, if it is convinced after such a review that no change in the cadre structure is required, the decision should be conveyed to DoPT with the approval of Minister in charge.
(ii) The cadre review proposal would be prepared by the Cadre Controlling Authority in the form of a Note for Committee of Secretaries. DoPT would obtain the approval of Secretary (P) and then refer it to Department of Expenditure for approval of Secretary (Expenditure).
(iii) The Note would then be placed before the Cadre Review Committee by DoPT.
(iv) Based on the recommendation of Cadre Review Committee, the proposal would be submitted for MOS (PP)'s approval. It would then be referred to theDepartment of Expenditure for Finance Minister's approval.
The Cadre Controlling Authority would then take approval of Cabinet. The
Note for Cabinet should ideally be prepared within a month of the Cadre Review
Committee's approval.
6. Composition of Cadre Review Committee-The Cadre Review Committee
would comprise the following functionaries:
(i) Cabinet Secretary Chairman
(ii) Secretary of the Ministry controlling the cadre Member
(iii) Secretary, Department of Personnel and Training Member
(iv) Secretary, Ministry of Finance, Department of Expenditure Member
(v) The senior most member of the service/cadre concerned Member
7. Restriction on direct recruitment-There is a restriction on direct recruitment to the extent that it should not exceed 3% of the total cadre strength. The authority to relax the condition rests with DoPT. It has now been decided to do away with this restriction. The Cadre Controlling Authorities are, however, advised not to resort to any bulk recruitment as it would create a bulge in the structure leading to stagnation at later stage. This may be kept in view while projecting recruitment planning.

DISCUSSION ON CADRE RESTRUCTURING
SYSTEM ADMINISTRATORS AND POSTMEN RELATED ISSUES.
An informal meeting with DDG (Estt.) and other officers on the issue of cadre restructuring has been held at the Directorate on 26.11.2010 .All General Secretaries of NFPE led by the Secretary General in the discussions.
The following are the gist of discussions of the meeting:
1. Since , GDS officials could get their Gr. ’D’ promotion only after 45 to 50 years of their age ,in most of the cases, they could not avail further promotions under MACP before their retirement from service. MACP is nothing but a mirage so for this cadre is concerned. They should be provided three promotions during their service with smaller span of service which was agreed to consider the proposal.
2. Similar is the case of postmen. Many of them could not get third MACP due to paucity of required minimum service. Cadre review should be carried out to provide three promotions to postmen within a span of twenty years. We were asked that the postmen on higher promotions should make data entries in the postmen module which was in principle agreed by us.
3. Further it was informally discussed to provide 20% of LGO vacancies under seniority cum fitness instead of writing LGO examination.
4. In respect of System Administrators it was discussed to carve-out separate the cadre from PA and convert it as promotional post for PA/SA. It was informed that creation of about 2000 to 2500 System Assistant posts will require a matching savings around 3000 PA/SA posts. We sought Grade Pay of Rs. 4200/- which is available in other Departments for the cadre of System Asstt. It was agreed to consider our proposal.
5. The Officials qualified in PO & RMS Accountants examination may be granted with Rs. 2800 Grade Pay and may be also posted in A/Cs Branches of Head Post offices. Carving out a separate cadre to Accounts line, shall also be explored for further promotional aspect to this cadre.
6. With regard to PA Cadre, the official side categorically informed that there is no chance of elevation of posts or hike in Grade Pay for any categories in the entry cadre under Cadre review proposals and only the number of promotional posts can only be increased on matching savings. We placed our concern about the justification of Grade Pay of Rs.4200/- to LSG which was finally agreed to consider.
7. Our demand to upgrade 11395 single handed Pos and 6719 double handed Posts Offices as LSG and 6621 present LSG posts to HSG-II posts and amalgamation of 1622 HSG-II posts and HSG-I posts to the present status of HSG-I will be considered. The DDG (Estt.) informed that in lieu of increased promotions. The Staff Side should come forward with proposals for matching savings. He suggested merger or closure of single handed sub post offices to the extent of 3000 in urban area which was strongly opposed by us.
8. We further demanded that at the time of upgradation of LSG, HSG-II and HSG-I posts some decent nomenclature should be given instead of present nomenclature.
9. The proposals on SBCO and Postal administrative offices will be discussed in the next meeting.
10. In RMS, we have demanded to increase the number of supervisory posts at least by three times to provide 1st, 2nd and 3rd promotions within 25 years.
11. The DDG (Estt.) refused to discuss about MMS drivers case since it is subjudice.
12. The meeting was only a preliminary one and detailed discussions will be held shortly with the members of the Committee with full fledged discussions.
POSTMEN RELATED ISSUES
One more meeting was also held on the same day to discuss about Postmen related issues. The following are the out come:
1. Postmen may not be entrusted with any data entry work other than issue of Speed Post and Registered articles entrusted for their delivery. Norms for this work may also be fixed.
2. Revision of norms on registered / un-registered articles delivered and also the time for distance travelled will be considered.
3. Norms will be considered for the left out items also.
4. A survey will be conducted to decide the minimum and maximum distance to be travelled by foot in congested and non-congested areas using milometer and cyclometer.
5. Distance conditions for cycle maintenance allowance may be reviewed.
6. Separate incentive for speed post should be given when the work is entrusted with normal duties.
We also opposed the unilateral introduction of single beat system in Metros and big Cities (e.g. Chennai). Proper compensation for excess duty or creation of additional posts should also be ensured.
SYSTEM ADMINISTRATORS
There was another meeting on 26.11.2010 to discuss the System Administrator’s issue. It was agreed to release orders shortly on grant of conveyance allowance. The duties and responsibilities and other issues will be discussed in the next meeting. Carving out a separate cadre from PA will be considered taking in to account the existence of System Assistant posts in other departments.
POSTMASTER’S CADRE:
The Department of Posts has released the Gazette Notification of Postmaster’s Cadre and numerous mails and calls are being received by Federation and CHQ. We want to make it clear that we are not against the creation of Postmaster’s Cadre. But we seek more betterment in the scheme. At present 1/3rd posts of LSG, HSG-II and HSG-I are identified for Postmaster’s Cadre.
We are seeking further following improvements in the order:
1. Before finalizing the options for Postmaster’s Cadre all the LSG, HSG-II and HSG-I posts should be filled up or all officials in 1st, 2nd and 3rd MACP should be allowed to exercise option to the newly formed Postmaster’s Cadre.
2. 25% posts of PS Gr.’B’ (Gazetted) Post Master posts shall be filled up from among the existing senior HSG-I officials at the initial stage itself.
3. APM Accounts and Accountants shall also be permitted to opt for the Postmasters Cadre.
We further desire to discuss this issue in threadbare during discussion in the Cadre Review Committee. A detailed note on this issue will be published soon.

RAILWAYS COMPLETES CADRE RESTRUCTURING
DISCUSSIONS WITH UNIONS
Dear Comrades - Postal Department has not come forward to even constitute a Joint Committee of Official and Staff Side Members to go into the proposals of cadre restructuring - But the Railways once again completed their cadre restructuring after 6th CPC implementation - The new proposals finalised by Railway Authorities and Railway Staff Side is given below for information.
As per the new proposals, the Railway Commercial Clerks whose entry level scale of pay PB-1 with GP 2000/- will go up to 4600/- GP in PB-2 on percentage basis. The cadre restructuring will place only 14% of Clerks in the entry level and 24% will be in next level of 2400 GP; next 44% will jump to 4200 GP; and the balance 18% will go over to 4600 GP in PB-2.
Take the case of Ticket Checking Staff in Railways who are on par with our LDC. These sections will be placed from the entry scale of 1900 GP to 4600 GP in PB-2 at the percentage of 14%:24%:44%:18%. This means through cadre restructuring the LDC level officials also go up to 4600/- GP in PB-2 in Railways.
Comrades! If Railways Cadre Restructuring can go up to 4600/- for officials with starting GP 1900- and 2000/- then why not Postal Assitants with entry GP 2400/- cannot go up to 4800/- through cadre Restructuring? Why the Postmen with 2000/- entry GP and LDCs with 1900/- GP in Department of Posts cannot go up to 4600/- GP like Railways?
The demand of Comprehensive Cadre Restructuring is a very important demand in the proposed July 13th Indefinite Strike by Postal JCA. If we mobilize fully and go with conviction that we shall win this demand, then we shall definitely win this demand. Organise with full vigour!
