An – Interesting CAT Decision


Abnormal delay in issuing a charge-sheet to an employee for his omissions and commissions leads to quashing of charge-sheet and also return of recovered money, if any amount is recovered from the charge-sheeted employee

Facts: While the Applicant was working as Accountant with effect from 21.5.1996 and BCR with effect from 1.7.2007, he was issued with a charge-memo under rule 16 of CCS (CCA) Rules vide Memo, dated 11.12.2008 for a matter which related to October, 1997, i.e. more than 11 years old. A recovery of Rs1,94,791 was to be recovered as per the order of SPOs, Sitapur, dated 27.03.2009. His appeals were rejected. Hence he filed this OA for setting aside his punishment.

The Applicant, Accountant-II, states that no undertaking was taken from him in regard to recovery of amount if any amount is paid by him incorrectly and that B. K. Tripathi, Accountant-I is fully responsible for the lapse and an amount of Rs.24,442 only is to be recovered from him. Further, the punishment order is non-speaking and hence liable to be quashed.

The Respondents sustain their orders based on various instructions of the Ministry of Finance and Chief Postmaster-General of U. P. Circle, Lucknow. They further state that an enquiry was conducted in the misappropriation of money and four persons including the Applicant was found responsible. Out of four, one had retired and another died. Hence no action was taken against them The Applicant and B. K. Tripathi, another employee were found guilty and an amount of Rs. 194791 and Rs. 24,442 respectively are to be recovered from them.

The Applicant placed reliance on the case of P. V. Mahadevan v. M. D. Tamilnadu Housing Board (2005 AIR SCWs 690), wherein the charge memo was quashed due to inordinate delay. In the case of State of M. P. v. Bani Singh, reported in AIR similar view of delay led to quashing of the charge-sheet. In the case of State of A. P. v. N. Radhakrishnan (1998 (4) SCC 154), it was held that in all situations in respect of delay in conclusion of departmental enquiry may vitiate the proceedings. Following these judgments, the tribunal passed similar orders in O. A. No. 427 of 2006. Jhabbar Yadav v. Union of India and others decided on 16.10.2008.

The Tribunal considering the delay in this case of 11 years which pertained to a case 11 years back examined the issue of charge-sheet and punishment thereon. The two employees now punished reportedly committed the mismanagement of money and on the pretext of having given and underataking for recovery, if found guilty is not sustainable. In that connections. It was held:

Held: “In view of aforesaid discussion, we come to the conclusion that there was an inordinate delay of about 11 years in issuing the charge-sheet for initiating disciplinary proceedings for which there is no proper explanation from the side of the Respondents. Therefore, having regard to the aforesaid preposition of law laid down by Hon. Apex Court (Supra) in the above cases, the disciplinary proceedings in question, deserved to be quashed, including order of recovery against Applicant initiated through charge-sheet, dated 11-12-2008 along with recovery Order, dated 27.03.2009. for the same reasons, the Appellate Order, dated 29.6.2009 is also liable to be quashed and accordingly it is so ordered. It is further directed that the amount already recovered, if any from the pay of the Applicant, shall also be refunded.”

The OA is allowed accordingly to the above extent.

MAKE ALL PREPARATIONS FOR ORGANISING CENTRAL GOVERNMENT EMPLOYEES AND WORKERS IN 28th FEBRUARY 2012 GENERAL STRIKE

HOLD CONFEDERATION STATE COMMITTEE MEETINGS AND WHEREEVER NO CONFEDERATION IN EXISTENCE ORGANISE MEETINGS OF ALL ORGANISATIONS OF CONFEDERATION AND PLAN FOR STRIKE.

ORGANISE THE CONFEDERATION STRIKE PREPARATORY MEETINGS AS PER THE SCHEDULE EXHIBITED IN THE WEBSITE WITHOUT FAIL.

THE MEETINGS OF CONFEDERATION IS MEANT FOR ALL OFFICE BEARERS AND EXECUTIVE COMMITTEE MEMBERS OF ALL CIRCLE ORGANISATIONS AFFILIATED TO CONFEDERATION - IT IS A LEADERS MEETING FOR PLANNING TO ORGANISE SUCCESSFULLY THE STRIKE - MAKE IT COMPULSORY TO ALL OFFICE BEARERS AND EXECUTIVE COMMITTEE MEMBERS OF ALL ORGANISATIONS TO ATTEND WITHOUT FAIL.

THE STRIKE CHARTER OF DEMANDS IS ONCE AGAIN EXHIBITED - THERE WAS A CORRECTION  OF TYPING ERROR IN THE EARLIER CHARTER OF DEMANDS THAT HAS BEEN INCORPORATED AND RE-EXHIBITED HEREUNDER:
  
Charter of demands.

PART-A.

1)  Concrete measures to contain price rise.
2) Concrete measures for linkage of employment protection with the concession/incentive package offered to the entrepreneurs,
3) Strict enforcement of all basic labour laws without any exception or exemption and stringent punitive measures for violation of labour laws.
4)  Universal social security cover for the unorganized sector workers without any restriction
5)  Creation of a National Social Security Fund with adequate resources in line with the recommendation, of NCEUS and Parliamentary Standing Committees on Labour, Stoppage of disinvestment in Central and State PSUs, the Central Trade Unions also demand immediate action by the Govt. of India to en sure:-
6)  No Contractorisatlon of work of permanent/perennial nature and payment of wages and benefits to the contract workers at the same rate as available to the regular workers of the Industry/establishment
7) Amendment of Minimum Wages Act to ensure universal coverage irrespective of the schedules and fixation of statutory minimum wage at not less than Rs 10,000/-,
8)  Remove the ceilings on payment and eligibility of Bonus, Provident Fund; Increase the quantum of gratuity.
9)  Scrap PFRDA Bill/New Pension Scheme; Ensure pension for all.
10) Compulsory registration of trade unions within a period of 45 days and immediate    ratification of ILO conventions 87 and 98.

PART-B

1. Stop downsizing, outsourcing, contractorisation, coporatorisation and privatization of     Governmental functions.
2.   Fill up all vacant posts and create posts on functional requirements.
3.  Revise wages of CGEs with effect from 1.1.2011 and every five years thereafter.
4.   Regularize the GDS, daily rated workers, contingent and casual workers by bringing  about a definite scheme of regularization.
5.  Remove restriction imposed on compassionate appointment ( end the discrimination on compassionate appointment between the Railway workers and other CGEs).
6.  Stop the move to introduce the productivity linked wage system; Performance related pay; introduce PLB in all Departments; remove the ceiling of emoluments for bonus computation.
7.  Settle all items of anomalies (including the MACP related anomalies) raised in the National and Departmental Anomaly Committee within a fixed time frame of two months; Set up the anomaly committees in those Departments where it has not been set up till date with the Standing Committee Members of the National Council; Convene the meeting of the Departmental Council in all Ministries / Departments once in three months as envisaged in the JCM Scheme.
8.   Make the right to strike a legal right and stop curtailment of TU Rights.
9.   Implement all Arbitration Awards.
10.  Raise the interest rate for GPF; Revise the OTA and Night Duty Allowance and Stitching and Clothing Rates of Uniforms.
11.  Merge DA with Pay for all purposes including Pension as and when the DA rates cross the 50% mark.
12.  Vacate all Trade Union Victimizations.

O R D E R

We have heard learned counsel for the parties.

During the course of hearing of this batch of appeals, the appellants represented by the Director(Staff), Ministry of Communication & I.T., Department of Posts filed an additional affidavit which may put an end tothe controversy between the parties. In fact, the said additional affidavit has been filed pursuant to certain observations made by this Court while hearing the appeals.

It is evident from the affidavit that the entire matter was reconsidered by the Department and upon such reexamination based on humanitarian considerations, found that out of 204 respondents in all 202 respondents working in the Department against short term/leave vacancies can be accommodated against compassionate appointment vacancies for the years 2000-01 to 2009 as per the departmental guidelines. However, in the case of Postal Assistants (PA)and Sorting Assistants (SA) cadre, according to the Ministry, the number of vacancies is not enough to accommodate all of them in the cadre. It is stated that the number of vacancies earmarked for this period is only 113 whereas the number of respondents claiming the relief is 152. However, it is stated that as a one time measure, the Department is willing to accommodate them against residual vacancies of the Department. The statement made in the affidavit is made part of the record directing the respondents to act upon the same

In the circumstances, the appellants are directed to regularize the services of all the 202 respondents who are working in the Department against short term/leave vacancies with effect from their date of appointment

However, the respondents shall not be entitled for payment of any arrears on account of such regularization. But their pay and pensionary benefits are protected.

In view of this order, it is made clear that the findings recorded by the Tribunal and as well as the High Court with regard to the interpretation of office memorandums and circulars of the Department are set aside and those findings and observations shall not be treated as precedent for the purpose of any other case or cases that may be pending.

The questions of law, if any, are left open.

The appeals are accordingly disposed of without any order as to costs. The interlocutory applications are accordingly allowed.

JUDGEMENT OF HON'BLE HIGH COURT OF MADRAS DISMISSINGS THE WRIT PETITION OF BPEF UNION






















HON'BLE HIGH COURT OF MADRAS DISMISSED THE WRIT PETITION FILED BY BPEF UNION AGAINST THE RECOGNITION OF NFPE & FNPO P3 UNION AND IRM & ASRM UNION

Judgment delivered by Hon'ble Justice F.M.Ibrahim Kalifullah categorically made it clear that under Rule 7 and 8 of CCS RSA Rules, 1993 any recognition granted to eligible unions cannot be withdrawn unless and until the process of verification for the subsequent period of verification is duly carried out as per the Rules and Department of Posts takes a final decision.

The Judgment also brought out clearly that all the facilities and rights enjoyed by the recognised unions shall continue be enjoyed by the NFPE P3 and FNPO P3 Unions and IRM&ASRM Unions until the ongoing verification is concluded.

Copy of Judgment is placed here for the benefit of all members. The Department of Posts which had earlier issued an order cancelling the trade union facilities of our Union is expected to issue fresh order at any time immediatly restoring all the trade union facilities granted to our union and other respondent unions and associations.

The Judgment is a heavy blow to the BPEF that again and again knocking the doors of one Hon'ble Court or other instead of concentrating amongst the workers to win their hearts for their survival. It is also a blow to the forces celebrating the withdrawal of trade union facilities to our organisation and the cancellation of foreign service to General Secretary P3 Union and the Secretary General NFPE.
