Sir/Madam,

 

I am directed to enclose a copy of Ministry of Finance. Department of Expenditure Implementation Cell O.M. F. No. 1/1/2008-IC dated 29th January, 2009 on the above mentioned subject for information and further necessary action.

 

In this context it is clarified that Ministry of Finance, Department of Expenditure, Implementation Cell vide their UO No. 10/1/2009 dated 15.05.2009 agreed to allow exercise of the split option by the eligible employees within one month of the copy of the O.M. cited above is circulated by the Department to the Subordinate/Circle Offices. Accordingly, the officials are allowed to exercise their option by 19.06.2009 i.e. upto one month from the date of issue of this letter.

Stoppage of Emergency Services at CGHS Wellness Centre (previously known as CGHS Dispensaries)
 
Now emergency services in CGHS dispensaries have been discontinued with immediate effect. It is mentioned that in emergency, the CGHS beneficiaries can reach any hospital for treatment, and hence the emergency services in CGHS Dispensaries have been discontinued. FIXATION OF PAY AND GRANT OF INCREMENTS IN THE REVISED PAY STRUCTURE CLARIFICATION REGARDING

 

Following the notification of the CCS (Revised Pay) Rules, 2008, this Department has received references from some administrative departments, seeking clarification regarding various aspects of fixation of pay in the revised pay structure as also pay fixation and grant of increments in future under the revised pay structure as also pay fixation and grant of increments in future under the revised pay structure. The matter has been considered in the Department. The points of doubt raised by administrative departments and the clarifications thereto are issued as under: -

As per the provisions of FR22 (I) (A) (1), split option has to be submitted by the eligible employee (other than those appointed on deputation to ex-cadre post or ad hoc basis or on direct recruitment basis) within one month of promotion. Some of the employees, promoted before 1.1.2006 as well as after 1.1.2006 but before notification of Revised Pay Rules, 2008 implementing 6th CPC recommendations, had opted for their pay fixation on promotion from the date of their next increment which was falling after 1.1.2006 in the 5th CPC scales as per the rules/pay structure then in force. Consequent upon implementation of recommendation of 6th CPC in August/ Sept 2008 effective from 1.1.2006, the option submitted by a number of employees has now turned to be disadvantageous. Whether such employees may be allowed to revise their options under FR22 (I) (A) (I).

DOP & T's OM No. 6/8.2000-Estt. (Pt.-I) dt. 25.2.2003 provides that a Government Servant may give a revised option for pay fixation under FR 22 (I) (a) (1) within one month from the date of orders of such unforeseen developments or change of rules. In any such cases, that have resulted from the notification of CCS (Revised Pay) Rule, 2008, Government Servants may be allowed to exercise a revised option for fixation of their pay in the promotion post within one month from the date of issue of these clarifications. If they have already not been allowed to do so under DOPT's O.M. dated 25.2.2003 mentioned above.

As per Rule 5 of the Central Civil Services (Revised Pay) Rules 2008, a Government Servant placed in a higher pay scale between 1.1.2006 and the date of notification of these rules on account of promotion, upgradation of pay scales etc. can elect to switch over to the revised pay structure from the date of such promotion (i.e. after placement in the promotional grade), upgradation etc. The employees promoted or upgraded to higher grade have option to have their pay fixed/re-fixed as per the provisions of FR 22/FR 23 from the date of next increment etc.

Whether such employees covered by Rule 5 of CCS (RP) Rules, 2008 can also revise their options now to choose either from the date of promotion/upgradation or the date of increment etc. (Which may fall on the 1st July 2006, 2007, 2008 or 2009 etc.) as annual increment in the new structure is given uniformly on 1st July?

Proviso to Rule 5 of CCS (RP) Rules, 2008 states that a Government servant may elect to continue to draw pay in the existing scale until the date on which he earns his next or any subsequent increments in the existing scale, or until he vacates his post, or ceases to draw pay in that scale.

The Rule ibid further provides that in cases where a Government servant has been placed in a higher pay scale between 1.1.2006 and the date of notification of these Rules on account of promotion, upgradation of pay scale etc. the government servant may elect to switch over to the revised pay structure from the date of such promotion, up gradation, etc.

It is clarified that such case will be regulated under proviso to Rule 5 of the CCS (Revised Pay) rules, 2008. After switching over to the revised pay structure, Clarification 2 (the method of fixation of pay on promotion after 1.1.2006) issued vide O.M. No. 1/1/2008-IC dated 13.9.2008 will apply.

In the case of ad-hoc promotions granted between 1.1.2006 and date of notification of CCS (RP) Rules, 2008, a Government Servant has the option to have his pay fixed under provision to Rule 5. However, Clarification 2 (the method of fixation of pay on promotion after 1.1.2006) issued vide O.M. No. 1/1/2008-IC dated 13.9.2008 will not apply in such cases.

As per Rule 13 (i) of CCS (RP) Rules, 2008, in the case of promotion from one grade pay to another and that involving change of pay band, one increment equal to 3% of basic may be allowed and in addition higher grade pay of the promotional post may also be allowed. As per clarification 2 of MOF OM No. 1/1/2008-IC dated 13.09.2008, on promotion from one grade to another, a Government servant has an option under FR 22 (I) (a) (1) to get his pay fixed in the higher post either from the date of his promotion, or from date of his next increment. As per the provisions of FR 22(1) (a) (1), the benefit of fixation under above rule is admissible only in cases of appointment involving duties & responsibilities of greater importance. Further , the grant of option under above FR is also subject to the condition that the appointment is not on deputation on ex-cadre basis/ad-hoc or direct recruitment basis

 

It is not clear whether.

(a)   FR 22 (1) (a) (1) still holds good in its present form with all the attendant conditions: or

(b)   The same has got modified on introduction of Sixth CPC Pay Structure; and if yes

(c)    What is the extent of modification to above FR.

Point No. (a): FR 22 (i) (a) (i) still holds good.

 

Point No. (b) & (c): Clarification No. 1/1/2008-IC dated 13th September, 2008 prescribes the method of fixation of pay under FR22(1) (a) (1) after introduction of the system of Pay bands and grade Pay.

Methodology for rounding off:

As per Rule 9 of the notification, the rate of increment in the revised pay structure will be 3% of the pay in the pay band and grade pay applicable, which will be rounded off to the next multiple of 10. Whether rounding off to next multiple of 10 has to be done in terms or rupees or even a paisa has to be rounded off the next multiple of 10. For example, if the pay after drawl of increment works out to Rs.10510.10 the same has to be rounded off to 10520 or 10510.

In the case Fitment Tables annexed with this
Department's OM of even number dated 30.08.2008, rounding off has already been done and the same should be implemented without any modification.

 

In the case of calculation of increments under the revised pay structure, paisa should be ignored, but any amount of a rupee or more should be rounded off to next multiple of 10. To illustrate, if the amount of increment comes to Rs.1900.70 paisa, then the amount will be round off to Rs.1900; if the amount of increment works out to be Rs.1901, then it will be rounded off to Rs.1910.

5.

Grant of stagnation increment:

Whether the employees who have been granted stagnation increment between February 2005 or thereafter are to be granted additional increment w.e.f. 1.1.2006, while fixing the pay or not? Since they have reached at the maximum of the existing pay scale.

In all cases, where a Government servant has been granted an increment (whether normal annual increment or stagnation increment) after January 1, 2005, no increment will be allowed on 1.1.2006 at the time of fixation of pay in the revised pay structure.

ORDERS ISSUED ON GROUP D FIXATION OF PAY AND SUBSTITUTES WAGES

OFFICE MEMORANDUM

 

Subject: Placement of non matriculate Group 'D' employees in the Pay Band PB-1 with effect from 1.1.2006

 

Consequent upon the  acceptance of the recommendations of Sixth Central Pay Commission by the Government, non-matriculate Government servants who were in the pre-revised Group 'D' scales are to be granted the revised pay structure in the following manner:

 

(i)                   Placement of all such employees initially in the corresponding -1S pay scale of Rs.4440-7440 with appropriate grade pay Rs.1300, Rs.1400, Rs.1600, and Rs.1650 w.e.f. 1.1.2006.

(ii)                 Fixation of pay of those employees, who already possess the revised minimum qualification of Matriculation or its equivalent, in PB-1 with grade pay of Rs.1800 with effect from 1.1.2006.

(iii)                Those employees who do not possess the prescribed minimum qualification would need to be retrained before being placed in the PB-1 pay band with grade pay of Rs.1800.

 

2. The Sixth CPC, while recommending higher pay scale to non-matriculate Group 'D' in PB-1, has suggested that job description of Group 'D' posts shall also be revised and redefined with emphasis on multi-skilling so that a single employee is able to perform various jobs. As per Rule 151 of Postal Manual Volume VI Part –III the Group 'D' posts in the Department of Posts are of the nature of general assistance in the office who must be ready to give their help wherever required. The duties of Group 'D' have also  been defined in Rules 144 to 152 of Postal Manual Vol VI Part III, which include wide range of functions. Keeping in view the changed environment and need of the time, following additional duties shall be entrusted to the staff in the Post Offices, RMS Offices and Administrative Offices who were in the pre-revised Group 'D' scales in addition to their existing duties:-

 

(A). Post Offices:

 

i.                     Sorting Mail

ii.                   Preparation of Mail/Register/Parcel Lists (Other than Insured lists), Regd/Parcel delivery slips, VP Receipts, Delivery lists for Registered articles, Money Order issue/paid lists, ACquittance Rolls etc

iii.                  Sale of Postage Stamps and Stationery

iv.                 Booking of Registered/Parcel articles

v.                   Basic data entry on Computers

vi.                 Record keeping

vii.                Booking of Speed Post articles

viii.              Receipt and dispatch of mails

ix.                 Duties of Caretaker

x.                   Any other duty assigned by the office.

 

(B). RMS Offices:

 

i.                     Sorting Mail

ii.                   Preparation of Mail/Registered/Parcel Lists

iii.                  Sale of Postage Stamps and Stationery

iv.                 Booking of Registered/Parcel articles

v.                   Basic data entry on Computers

vi.                 Record keeping

vii.                Booking of Speed Post articles

viii.              Receipt and dispatch of mails

ix.                 Handling customer enquires

x.                   Duties of Caretaker

xi.                 Any other duty assigned by the office.

 

(C). Administrative/Other Offices including DA(P)s:

 

i.                     Maintenance of Diary/Dispatch/Movement Registers or making entries in the computer

ii.                   Linking of receipts in the files already opened

iii.                  Submission of periodical statements of routine nature like Absentee Statement etc

iv.                 Indenting and maintenance of Stationery in the Section/office

v.                   Record keeping

vi.                 Photocopying and preparation of sets

vii.                Duties of Caretaker

viii.              Basic date entry on Computers

ix.                 Any other duty assigned by the office

 

These employees will henceforth be known by the generic term of "Multi Skilled Employees". However, the specific designations like Mail Peon, Mail Man etc will continue and they will continue to perform the existing duties along with the assigned additional duties.

 

3. The issue was referred to Ministry of Finance for fixation of the pay scales of these employees of Department of Posts before completion of the training and that Ministry has concurred in the proposal subject to the conditions that necessary computer training may be provided to enhance their skill. Action may be initiated by the Heads of Circles to complete the required training on computer operations in consultation with the Training Division of the Directorate. Training Division of the Directorate will take necessary action to get the module developed to train all such non-matriculate employees in basic data entry and circulate to all Circles. The Divisional Superintendents/Controlling Authorities should ensure that the training is imparted and required certificate is issued about completion of the prescribed training and necessary entry recorded in the Service Book of each official.

 

4. (i) All the Multi Skilled Employees who were in the pre-revised Group 'D' pay scales will be placed in the revised pay bands as indicated below with effect from 1.1.2006:

(ii) Inter-se seniority of all the employees in erstwhile Group 'D' will be fully maintained with Group 'D' employee in a higher Fifth CPC pay scale being placed higher vis-à-vis an employee in a lower pay scale. Within the same pre-revised pay scale, the seniority will be fixed on the basis of date on which the person came to be placed in that pay scale.

 

5. Heads of Circles will please issue necessary instructions to all the concerned to take prompt  action to complete the entire process including training by 30.04.2009 and report compliance to the undersigned latest by 15.05.2009.

 

6. This issues with the concurrence of Ministry of Finance, Department of Expenditure, I.C. vide their U.O.No. 7.6/7/2009-IC dated 12.3.2009.

Subject: Remuneration to be paid to the Gramin Dak Sevaks engaged as substitutes in short-term vacancies of Postmen/Mail Guards and Group 'D'

               

Consequent upon the implementation of the Sixth Central Pay Commission's recommendations, the matter regarding the rates of remuneration payable to Gramin Dak Sevaks engaged as substitutes in short term departmental vacancies of Postmen, Mail Guards & Group 'D' (Future Multi Skilled Employee) has been reviewed.

 

2. It has now been decided that the remuneration of the Gramin Dak Sevaks engaged as substitutes in short term departmental vacancies of Postmen, Mail Guards & Group 'D' (Future Multi Skilled Employee) may be calculated on the basis of the minimum of the pay in the respective revised pay band of the post plus grade pay concerned i.e. Posmen, Mail Guards Rs.5200 + Rs.2000 and Group 'D' Rs.5200 + Rs.1800 as the case may be as defined in the CCS (Revised Pay) Rules, 2008 plus admissible Dearness Allowance thereon only excluding House Rent Allowance and Transport Allowance with effect from 1.1.2006.

 

3. In future, GDS who are willing to work as substitutes with the minimum pay of the revised pay band of the respective post plus admissible DA excluding House Rent Allowance and Transport Allowance,, should be engaged as substitutes only after obtaining an undertaking in this regard.

 

4. The issue relating to grant of revised wages to casual labourers of Full time / part time contingent workers is under examination and orders will be issued separately.

 

5. This issues with the concurrence of Ministry of Finance, Department of Expenditure, I.C. vide their U.O. No.7.6/7/2009-IC dated 12.3.2009.

HOW TO FIX PAY IN UPGRADED PAY STRUCTURE FOR POSTMEN?

Dear Comrades! More Orders have been released on the above issues. The details are as under:

 

HOW TO FIX IN UPGRADED PAY FOR POSTMEN / MAILGUARD?

 

The Basic Pay as on 1.1.2006 in the pre-revised 3050-4590 pay scale should be refixed as per the fitment table of the pre-revised scale of 3050-4590 and then the Grade Pay of upgraded scale viz., 2000/- should be added. This pattern is to be applied for Postmen and allied cadres in the Department of Posts. This is the clarification issued and therefore wherever the higher grade pay 2000/- is not given to Postmen, this latest clarificatory orders of Department of Expenditure dated 13.10.2008 may be shown to the DDO for appropriate correct fixation. REIMBURSEMENT OF TRAVEL WITHIN CITY
 

Orders have been issued clarifying that reimbursement of taxi fare from residence to railway station and back to headquarters etc are continue to be applicable in addition to the reimbursement of travel within city. MODIFICATION OF 2.9.2008 ORDERS ON REVISION OF PROVISIONS REGULATING PENSION ETC.

 

Though this clarificatory orders allows payment of Constant Attendent Allowance from 1.1.2006 instead of 2.9.2008 and additional quantum of pension on attaining 80 years of age is allowed from the 1st of the month in which the birth day falls etc, has denied the benefit of the pay commission's recommendations on either of last pay drawn or average of 10 months pay whichever is greater to officials who retired between 1.1.2006 and 2.9.2008. This order however grants the benefit to post 1.1.2006 pensioner so that his pension is not below the 50% of the pay band + Grade Pay of the scale in which the above official had retired.
