Sub: - Misusing of quasi-judicial powers and ordering recovery against the innocent officials who are not directly responsible – case of Erode division in Tamilnadu circle

Sir,
A kind attention is invited to the discussions we had on the charter of strike demands and also in the Departmental Council JCM about the misuse of quasi-judicial powers by the divisional heads and ordering huge recoveries against the innocent officials who are not directly responsible for the loss sustained by the department and made them scape goats leaving the main and co offenders as scat free in case of officers involved. It has been asked by the Secretary himself to cite some instances about the misuse of disciplinary powers in the case of contributory negligence factors.
The Copy of the Tamilnadu Circle Union letter dated 27.2.2019 about the fraud taken place at Erode division in Tamilnadu circle and the role of the divisional heads and sub divisional heads, and the present action of the divisional administration to fix the innocent officials as scape goats which is self-explanatory and exhaustive is enclosed herewith for your kind intervention and immediate action.
It is dismayed to note that there was no action taken to confiscate the movable and immovable properties from the main offender and also the co offenders who admitted their guilty in the CBI enquiry. The officers who are responsible have not been brought as the co offenders in the fraud case and action is being initiated against the innocent and hardworking officials on flimsy and fabricated reasons. The above case is clear example for misusing the powers and also misusing the quasi-judicial power vested with the divisional head. The regional administration was appraised all these facts in 2017 itself but there was no action and they are being responsible for the delay in confiscating the properties from the main and co offenders.
It is therefore requested to kindly cause immediate action to stop the action against the innocent officials and proceed to recover the amount from the main and co offenders immediately.

OFFICE MEMORANDUM

Subject: Grant of Dearness Allowance to Central Government employees - Revised Rates effective from 1.1.2019.


The undersigned is directed to refer to this Ministry's Office Memorandum No. 1/2/2018-E-ll (B) dated 7th September, 2018 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 9% to 12% of the basic pay with effect from 1st January, 2019 .

2. The term 'basic pay' in the revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix as per 7th CPC recommendations accepted by the Government , but does not include any other type of pay like special pay, etc.

3. The Dearness Allowance will continue to be a distinct element of remuneration and will not be treated as pay within the ambit of FR 9(21).

4. The payment on account of Dearness Allowance involving fractions of 50 paise and above may be rounded to the next higher rupee and the fractions of less than 50 paise may be ignored.

5. The payment of arrears of Dearness Allowance (from January to March) shall not be made before the date of disbursement of salary of March, 2019.

6. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In respect of Armed Forces personnel and Railway employees , separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.
7. In so far as the employees working in the Indian Audit and Accounts Department are concerned , these orders are issued with the concurrence of the Comp r ler and Auditor General of India.
