HIGHLIGHTS FROM HEADQUARTERS
  • Junior Accountants residency period before promoted to Senior Accountants - Department of Posts order for restoring the earlier 3 years period instead of 6 years is expected to be issued shortly. It is confirmed that the DOPT has favourably decided to restore status-quo-ante on this issue. NFPE Delegation which met the Director [PAF] got the above confirmation. This is a victory to the combined efforts of All India Postal Accounts Employees Association [AIPAEA] - NFPE - and Confederation. The NFPE and AIPAEA have placed the issue in the Strike Charter and also discussed with the Secretary [P] level meeting on 13.01.2009 and also consistently trying to settle the issue. Confederation of Central Government Employees played a major role in settlement of issue at the DOPT level. Comrade S.K.Vyas President Confederation and also JCM National Council Standing Committee Member took personal interest in the issue and paved the way for settlement. Postal Accounts Employees can now rejoice the victory.

  • Much sought out relief for the Postal Accounts Employees stationed in Jammu who aspire to go back to Kapurtala is in the offing. Consequent on the DOPT cancelling the Screening Committee operations w.e.f. 1.4.2009, there will be no problem for future recruitment process and hence the long pending requests of officials for going back to Kapurtala DAP from Jammu would now be processed quickly. This was assured to the delegation of NFPE by the Director PAF. This issue was also being pursued vigourously by the AIPAEA and NFPE for many months.

  • NFPE Delegation consisting of Secretary General NFPE and General Secretaries P3 and R3 met the DDG[Establishment] on 22.04.2009. The issues of Cadre Restructuring; Road Mileage Allowance to System Administrators; Doubling of PO&RMS Accountants Special Allowance and grant of Special Allowance to TBOP Officials man the post of PO&RMS Accountants; Implementation of Group D higher pay for all Group D; Stopping recovery of OTA amount paid to ineligible Officials; Formation of Anomaly Committee for 6th Pay Commission related issues; Revision of FSC; and Recovery from APM Accounts Pune for over-drawal-to Postmen.

  • Delay in processing of Cadre Restructuring issue and formation of Anomaly Committee is raised by us. We were told that the proposals for Cadre Restructuring from FNPO has not been submitted. We reminded that our consolidated proposals have been submitted on 15.01.2009 and that the Department can process our proposals and react with their own views. The Anomaly Committee formation will be taken up only after the FNPO nominates their two representatives. We have also approached FNPO leaders for early nomination of their members.

  • DDG[Estt] showed his directions for fixation of higher pay for all Group D as per DOP Orders dated 27.03.2009 before the end of April 2009 and also for completion of one-week training to all non-matriculate Group D. Circles / Divisions to monitor the progress to ensure fixation of higher pay scale with 1800/- Grade Pay to all Group D before end of April 2009.

  • DDG ordered study of our proposal for grant of Road Mileage Allowance to System Administrators for taking early favourable decision.

  • The issues of PO&RMS Accountants; OTA to ineligible officials; Revision of FSC; Recovery of over-drawal from APM Accounts Pune will be favourably looked into by the Department.

  • It is ascertained that after the GDS file gone to Finance Ministry, no further information on the progress could be available. The implementation of GDS Committee and or Adhoc Payment of arrears etc appear likely only after the conclusion of General Elections.

  • ACP orders also only after General Elections.

EDITORIAL MAY' 2009 (BHARTIYA POST)

NFPE – THE SINE-QUA-NON OF POSTAL WORKERS

BE PROUD OF BEING IT'S BASIC MEMBER

 

The NFPTE has come into existence on 24.11.1954 under realignment scheme of the then existing unions, since Sri Jagjiwan Ram, the then communication Minster felt multiciplity of unions disturbed the industrial peace.

 

The NFPTE has grown as powerful organization since there was one union for one industry under the realignment Scheme. The Government has agreed to the principle of one union in one Industry then and formation of JCM in 1967 also blocked the process of further disintegration of trade unions in the Government Services as provision was made that no new union will be recognized in departments where a Federation/Union broadly and adequately representing all categories of staff already exists.

 

In the Railways and Defence, the Ruling party had its own set up but that could not be implemented in P&T due to the realignment scheme. The Government refused to recognize INTUC set up in the Postal after the 1960 strike.

 

But in the Post 1968 strike, the Government took advantage of the situation and decided to crush the NFPTE and first derecognized the NFPTE. It resorted all sort of repressive measures like dismissals, suspensions, removals, disciplinary charges etc against the leaders and cadres of the mighty National Federation of Post & Telegraph Employees.

 

The Government recognized FNPTO after the 1968 Strike and amidst derecognition of NFPTE and under repressive victimization with all patronage duly the declared the end of realignment scheme. Thereafter during Janata regime, the most corrupted Minister Sri. Brijlal Verma has recognized BPTEF on political consideration. After bifurcation of Postal & Telecom, the NFPTE in Postal was renamed and called as National Federation of Postal Employees.

 

However, the NFPTE/NFPE survived and flourished despite the existence of FNPO & BPEF. The NFPE has never compromised its character and still it is having more than sixty five percent work force in its fold in the Postal.

 

NFPE with its glorious history and tradition is determined to serve the Postal workers to improve the economic and service conditions and continue to serve as a vanguard of the Central Government employees movement as a whole.

 

NFPTE recognized the need of overall unity of C. G. employees and because of that the Confederation of Central Government employees was formed on Com. Dada Ghosh's initiative to make the 1957 strike action a resounding success.

 

NFPTE raised the issue of economic freedom for P& T employees first. It sought the removal of disparities in leave, medical rules etc between class III and class IV. The NFPTE demanded appointment of second Pay commission and pleaded the concept of economic freedom as per the 15th ILC decision on a need based minimum wage.

 

The historic one day strike on 19.09.1984 by P4 on ED demands has cutting the ice of doubt about the possibility of conducting strikes in Central Government services after 1968 & 1974 which faced lot of victimization and repressive measures against the striking comrades and it proved the revival and militancy of Postal Comrades after 1968.

 

NFPE become the spokesman, fighter and defender of the interests of the entire Central Government employees. It has faith in negotiations failing which it settles issues by struggle. NFPE is having nation's interest and it has actively participated in all the struggles against the Neo economic policies and Liberalization, Globalization, Privatization etc.

 

NFPE has built its own port with blood, sweat, tears and sacrifice as bricks, lime and stones which could not be demolished even in the dark days of emergency despite several concessions were extended to scab unions. It never happened to any other unions that the journals of NFPTE & its unions were burnt in transit during Emergency days and leaders were put behind the bars. But the NFPTE/NFPE has survived and emerged more stronger and stronger and united.

 

NFPTE reached agreement in 1974 on 20% promotional avenue for P & T workers. It was successful in getting 16 holidays plus two restricted holidays for the P & T operative staff. NFPTE was first resolved demanding Bonus to C. G. employees and it was achieved. NFPTE was the reason behind in achieving two promotions when no such promotion was available to C. G. employees.

 

Now NFPE after the P& T bifurcation through its affiliates shall remain as the most representative body embracing all cadres. There is a total unity among the affiliates and work together for the betterment of Postal brethren.

 

NFPE has survived and grown despite various attacks by the Government and bureaucracy because of its determination to maintain rock-like unity at the base, take decisions by consensus. Mostly some self centered vested interests who could not come out successful in election process alone deserted from this movement for their personal ambitious and wishes by kicking the ladder by which they were elevated and become taken prey for petty reasons.

 

NFPE enjoys a unique stature in the fraternity of the Working class. It has been pursuing a broad based policy and taking decision by consensus on all occasions. It always aim to build organizational unity and a united approach. Our policies towards the Government and Department are neither from fear nor for favours but varies from issue to issue.

 

The deep rooted traditions, sentiments, confidence and loyalty of the members led the NFPE with more strength to serve the workers better. NFPE is the movement built by sacrifice of so many martyrs. Not only, it is the major Federation, it is deep routed in the sentiments of all workers.

 

Let us strengthen our organization with more membership in the current verification. The Postal Three, the intellectual affiliate of NFPE will prove its second none by upholding its banner with increased membership.

 

Of course! It is possible! Approach each and every member who are new entrants! Appraise our history commitment and no compromise in settlement of staff problems. Approach the old comrades who deserted from us to various reasons and seek their re-enrolment for the better tomorrow. Let us strengthen our movement more in organizationally which will gain more bargaining power. If each member is motivated with this task, certainly every thing is possible.

NFPTE 1957 AGITATION REVOKED RESPONSE FROM PRIME MINISTER

 

"The whole incident (1957 strike agitation) has a lesson for all of us, both Government and workers as well as others, and unless all of us learn this lesson, we shall be faced with similar situations. We should not blame the workers, for they have been hard hit by the economic situations. We must evolve ways of trying to solve problems as they arise and not wait for a crisis. "Every official in the Department is supposed to have the contents of these four volumes of Manual at his finger's end, but in reality few have ever read them through; and any one who attempted to obey all their instructions would find himself sadly hampered in the exercise of his duties." But what of that? This frank admission by Mr. Clark does not at all count when punishment is determined, and it goes on merrily as ever. We must seriously take up this question of punishment and the treatment due from superior officers. We cannot allow our manhood to be destroyed by such constant terror of punishment hanging like Damocles' sword over our head."

Ø  Another list of members in Triplicate duly signed in each page by the Secretary should be submitted to the concerned divisional superintendent on or before 20.05.2009.

 

Ø  Divisional Heads will scrutinize the applications in the presence of one representative from each applicant union before 25.05.2009.

 

Ø  Divisional heads will return the lists and declaration forms to DDOs and the DDOs will return to the union one copy of list of members and will exhibit another list in the notice board from 27.05.2009 to 29.05.2009.

 

Ø  Members will be provided an opportunity to represent against any fraudulent use of their name or signature by any union upto 02.06.2009 in writing to divisional head.

 

Ø  Recovery of subscription will be made from June salary.

 

Please educate the employees that signing for two or more unions will result their non membership in any union for five years.

CLARIFICATION ON PAY & INCREMENTS

FIXATION OF PAY AND GRANT OF INCREMENTS IN THE REVISED PAY STRUCTURE CLARIFICATION REGARDING

 

Following the notification of the CCS (Revised Pay) Rules, 2008, this Department has received references from some administrative departments, seeking clarification regarding various aspects of fixation of pay in the revised pay structure as also pay fixation and grant of increments in future under the revised pay structure as also pay fixation and grant of increments in future under the revised pay structure. The matter has been considered in the Department. The points of doubt raised by administrative departments and the clarifications thereto are issued as under: -

As per the provisions of FR22 (I) (A) (1), split option has to be submitted by the eligible employee (other than those appointed on deputation to ex-cadre post or ad hoc basis or on direct recruitment basis) within one month of promotion. Some of the employees, promoted before 1.1.2006 as well as after 1.1.2006 but before notification of Revised Pay Rules, 2008 implementing 6th CPC recommendations, had opted for their pay fixation on promotion from the date of their next increment which was falling after 1.1.2006 in the 5th CPC scales as per the rules/pay structure then in force. Consequent upon implementation of recommendation of 6th CPC in August/ Sept 2008 effective from 1.1.2006, the option submitted by a number of employees has now turned to be disadvantageous. Whether such employees may be allowed to revise their options under FR22 (I) (A) (I).

DOP & T's OM No. 6/8.2000-Estt. (Pt.-I) dt. 25.2.2003 provides that a Government Servant may give a revised option for pay fixation under FR 22 (I) (a) (1) within one month from the date of orders of such unforeseen developments or change of rules. In any such cases, that have resulted from the notification of CCS (Revised Pay) Rule, 2008, Government Servants may be allowed to exercise a revised option for fixation of their pay in the promotion post within one month from the date of issue of these clarifications. If they have already not been allowed to do so under DOPT's O.M. dated 25.2.2003 mentioned above.

As per Rule 5 of the Central Civil Services (Revised Pay) Rules 2008, a Government Servant placed in a higher pay scale between 1.1.2006 and the date of notification of these rules on account of promotion, upgradation of pay scales etc. can elect to switch over to the revised pay structure from the date of such promotion (i.e. after placement in the promotional grade), upgradation etc. The employees promoted or upgraded to higher grade have option to have their pay fixed/re-fixed as per the provisions of FR 22/FR 23 from the date of next increment etc.

Whether such employees covered by Rule 5 of CCS (RP) Rules, 2008 can also revise their options now to choose either from the date of promotion/upgradation or the date of increment etc. (Which may fall on the 1st July 2006, 2007, 2008 or 2009 etc.) as annual increment in the new structure is given uniformly on 1st July?

Proviso to Rule 5 of CCS (RP) Rules, 2008 states that a Government servant may elect to continue to draw pay in the existing scale until the date on which he earns his next or any subsequent increments in the existing scale, or until he vacates his post, or ceases to draw pay in that scale.

The Rule ibid further provides that in cases where a Government servant has been placed in a higher pay scale between 1.1.2006 and the date of notification of these Rules on account of promotion, upgradation of pay scale etc. the government servant may elect to switch over to the revised pay structure from the date of such promotion, up gradation, etc.

It is clarified that such case will be regulated under proviso to Rule 5 of the CCS (Revised Pay) rules, 2008. After switching over to the revised pay structure, Clarification 2 (the method of fixation of pay on promotion after 1.1.2006) issued vide O.M. No. 1/1/2008-IC dated 13.9.2008 will apply.

In the case of ad-hoc promotions granted between 1.1.2006 and date of notification of CCS (RP) Rules, 2008, a Government Servant has the option to have his pay fixed under provision to Rule 5. However, Clarification 2 (the method of fixation of pay on promotion after 1.1.2006) issued vide O.M. No. 1/1/2008-IC dated 13.9.2008 will not apply in such cases.

As per Rule 13 (i) of CCS (RP) Rules, 2008, in the case of promotion from one grade pay to another and that involving change of pay band, one increment equal to 3% of basic may be allowed and in addition higher grade pay of the promotional post may also be allowed. As per clarification 2 of MOF OM No. 1/1/2008-IC dated 13.09.2008, on promotion from one grade to another, a Government servant has an option under FR 22 (I) (a) (1) to get his pay fixed in the higher post either from the date of his promotion, or from date of his next increment. As per the provisions of FR 22(1) (a) (1), the benefit of fixation under above rule is admissible only in cases of appointment involving duties & responsibilities of greater importance. Further , the grant of option under above FR is also subject to the condition that the appointment is not on deputation on ex-cadre basis/ad-hoc or direct recruitment basis

 

It is not clear whether.

(a)   FR 22 (1) (a) (1) still holds good in its present form with all the attendant conditions: or

(b)   The same has got modified on introduction of Sixth CPC Pay Structure; and if yes

(c)    What is the extent of modification to above FR.

Point No. (a): FR 22 (i) (a) (i) still holds good.

 

Point No. (b) & (c): Clarification No. 1/1/2008-IC dated 13th September, 2008 prescribes the method of fixation of pay under FR22(1) (a) (1) after introduction of the system of Pay bands and grade Pay.

Methodology for rounding off:

As per Rule 9 of the notification, the rate of increment in the revised pay structure will be 3% of the pay in the pay band and grade pay applicable, which will be rounded off to the next multiple of 10. Whether rounding off to next multiple of 10 has to be done in terms or rupees or even a paisa has to be rounded off the next multiple of 10. For example, if the pay after drawl of increment works out to Rs.10510.10 the same has to be rounded off to 10520 or 10510.

In the case Fitment Tables annexed with this
Department's OM of even number dated 30.08.2008, rounding off has already been done and the same should be implemented without any modification.

 

In the case of calculation of increments under the revised pay structure, paisa should be ignored, but any amount of a rupee or more should be rounded off to next multiple of 10. To illustrate, if the amount of increment comes to Rs.1900.70 paisa, then the amount will be round off to Rs.1900; if the amount of increment works out to be Rs.1901, then it will be rounded off to Rs.1910.

Grant of stagnation increment:

Whether the employees who have been granted stagnation increment between February 2005 or thereafter are to be granted additional increment w.e.f. 1.1.2006, while fixing the pay or not? Since they have reached at the maximum of the existing pay scale.

In all cases, where a Government servant has been granted an increment (whether normal annual increment or stagnation increment) after January 1, 2005, no increment will be allowed on 1.1.2006 at the time of fixation of pay in the revised pay structure.

OPTIMISATION OF DIRECT RECRUITMENT TO CIVILIAN POSTS – REGARDING

The undersigned is directed to refer to the above-cited subject and to say that vide this departments O.M. No. 2/8/2001-PIC dated 16th May 2001, the scheme of Optimization of Direct Recruitment to Civilian Posts was introduced for five years with the objective of rationalization of the manpower in various Ministries/Departments of the Government of India. As per the Optimization Scheme, all Ministries/Departments were mandated to prepare the Annual Direct Recruitment Plan for each year in order to prioritize the fresh intake of manpower. After the expiry of the initial five years period, the Optimization Scheme was reviewed in the year 2006 in consultation with the Department of Expenditure, Ministry of Finance and it was decided to extend the scheme for a further period of three years i.e., up to 31st March 2009 subject to a review after the receipt of the recommendations of the Sixth Central Pay Commission.

 

In this regard, the Sixth Central Pay Commission has recommended, "multiskilling of the Government employees which would increase their operational efficiency while simultaneously optimizing the staff strength. Ii is however, noted that while rightsizing in Government is necessary given the changes in the work process due to technology and consequent reduction of layers, a blanket ban on filling up of vacant posts across the board can impact effective functioning. More flexibility is required in this policy for effective service delivery and care has to be taken that administrative delivery structures do not become hollow or thin in critical areas ………..", (Para 6.3.10)

 

Keeping in view the above recommendation of The Sixth Central Pay Commission, the optimization policy has again been reviewed in consultation with the Department of Expenditure, Ministry of Finance and it has been decided not to extend the validity of the Optimization Scheme beyond 31.03.2009.

INCENTIVE FOR NREGS WORK – UNIFORM TO ALL

 

SUPPORT FOR PAYMENT OF WAGES UNDER NATIONAL RURAL EMPLOYMENT GUARANTEE SCHEME – ALLOTMENT OF FUND FOR THE YEAR 2008-09.

 

1.      A provision has been made in the Plan funds to meet the expenditure incurred towards implementation of National Rural Employment Guarantee Scheme (NREGS) made available during the year 2008-09, the activities on which this amount is to be utilized and the head of account are given in the table of allotment enclosed (Annexure – I)

 

2.      The funds under the above scheme are placed at the disposal of Circles for implementation of the NREG Scheme. A provision has also been made for North East region consisting of Assam and North East Circles separately in the Annexure – II.

 

3.      The guidelines and conditions governing the payment of incentive to the officials on account of additional work due to opening and operations of NREGS accounts in enclosed in Annexure – II.

 

4.      All expenditure incurring offices may prepare a monthly statement giving date. Amount, nature of work in respect of all items booked against present fund allotment.

 

5.      The funds should be utilized within the allotment made under each activity for this financial year 2008-09 after obtaining expenditure approval of the competent authority in each case. Director (Budget), Department of Posts to whom a copy of this letter has been endorsed is being requested to allot necessary funds as aforesaid to the respective Circles. It must be ensured that the funds allotted are utilized within the current financial year and booked in the appropriate head of account as indicated in Annexure – I.

ANNEXURE – II

INCENTIVE STRUCTURE FOR NREGS WORK

 

Conditions governing grant of incentive under NREGS work

 

1.      Incentive is eligible as per table below for NREGS work per account with at least 10 transactions in that account in a financial year. Both deposits and withdrawals will be taken in to account of the purpose of arriving at the number of transactions.

 

2.      If more than one official has worked on any particular post then the incentive may be decided based on the following guidelines:

(a)   Incentive is eligible of those officials only who have worked on a post of at least 3 months

(b)   The incentive should be paid on pro-rata basis for the period of work and the total being limited to the maximum eligible incentive based on the total number of accounts in a financial year.

 

3.      Incentive should be calculated on the basis of work carried out in a particular financial year only.

 

4.      The incentive payable to employees on account of additional work due to opening of NREGS accounts should be restricted to the ceiling as laid down by Department of Personnel and Training and administrative orders issued form time to time by the Department of Posts.
