CONSOLIDATED INSTRUCTIONS ON RESERVATION

DOPT SEEKS COMMENTS BEFORE 12.7.2010

The DOPT vide its OM No 36011/6/2010 – Estt (Res) dated 25.6.2010 invite comments about the consolidated instructions of various Govt orders on reservation for the scheduled castes, scheduled tribes and OBCs in services under the Govt of India and exhibited the same in its website for public domain.

The instructions on Reservation for the Scheduled Castes, Scheduled Tribes and Other Backward Classes in services under the Government of India are contained in various OMS issued from time to time by the Ministry of Home Affairs and this Department. Some of the instructions so issued have become outdated and are not in operation at present. It has, however, been observed that some appointing authorities are continuing to implement such outdated and non-existent instructions.

Keeping all these aspects in view DOPT has decided to issue consolidated instructions on Reservation for the Scheduled Castes, Scheduled Tribes and Other Backward Classes in supersession of all the existing instructions on the subject. The proposal is not to change any aspect of policy on the subject but only to consolidate all the instructions and present them in easy to understand fod language. A draft OM has been prepared which covers all the aspects of reservation policy as existing at present. However, before issuing the proposed OM, it has been decided to put it in public domain and invite comments on it. If any person feels that the proposed OM does not include any of the existing instruction or any instruction included in the proposed OM is not in consonance with the existing instructions, may point out the same and send his comments to Sri K.G.Verma, Director, DOPT, New Delhi by 12* July, 2010

PREPARE FOR INDEFINITE STRIKE FROM 13 JULY 2010

MOBILISE ONE AND ALL

We have to apply ourselves to the task of mobilizing each and every employee irrespective of their affiliations in the unions, educate them the rationale behind the struggle programme and the need for the cent percent participation in the ensuing indefinite strike to be held from 13.7.2010.

The struggle is mainly launched against the policy offensives unleashed by the present Govt and the department with a prelude to corporatization and privatization of postal services in the days to come. Supreme and strenuous efforts are required to ensure that all our ranks are ready for this massive programme. This task is most important and urgent and the need of the hour.

Time is too short. Organise tour programmes. Visit the post offices in person. Explain the rank and file about the need of the programme and the unilateralism practices by the postal authorities in dealing the unions. Explain the discriminatory treatment met out by them in all service matters whether it is cadre restructuring or revision of daily allowance, overtime allowance etc among them and the railway employees.

Prepare for the massive strike from 13th July 2010 – Our tasks

1. Contact each and every worker in your office and convince him about the inevitability of the struggle.

2. Hold gate meetings, lunch hour meetings, meetings of active workers, General body meetings, joint meetings to explain in detail about the charter of demands and that every possible attempt was made to parley to reach an amicable settlement but resulted in vain.

3. Filling up of the vacant posts, shortage of staff, consideration of cadre review proposals, full fledged staff to project arrow offices revival of negotiations forums are the basic demands in which no compromise could be arrived. There will be no compromise on policy issues to save postal and RMS.

4. Maximum mobilization and massive action alone can compel the Govt to concede our basic demands.

DON’T THINK THAT THERE WILL BE NEGOTIATIONS AND STRIKE MAY NOT TAKE PLACE .THE SITUATION IS TOTALLY DIFFERENT. THERE IS NO POSITIVE EFFORTS TO SORT OUT THE ISSUES IN THE ACTION TAKEN STATEMENT SENT BY THE DEPARTMENT.

THIRTEENTH JULY 2010 WILL DAWN WITH THICKNESS IN THE AIRAND WARMTH IN THE EARTH.THE SPIRIT OF DEFIANCE, DETERMINATION AND THE DEPTH OF THE FEELINGS OF THE WORKERS WILL UNLEASH ITSELF WITH FORCE AND FIRMNESS AND IN FULL STRENGTH.

LET ALL REFUSE OUR LABOUR TO THE EMPLOYER TILL OUR GENUINE DEMANDS ARE MITIGATED

BE PREPARED. MOBILSE ONE AND ALL. MAKE THE GOVT TO COME DOWN AND SETTLE OUR DEMANDS.

Com. K. Ragavendran Ex-Secretary General, NFPE who was relinquised from the post of Secretary General in the last Federal Council due to his superannuation and as per the requirement under RSA Rules 1993. Of course; it is a loss to the movement. His selfless sacrificed dedicated service, has raised the image of the Federation to the highest. We are proud to have him as Working President and his role and contribution to this movement is a colourful chapter. His performance as Secretary General earned well merited encomiums and praise from all sections of the postal workers. We wish him a Happy and peaceful retired life and let his services be extended to the working class in general and in particular to guide us in the days to come. Long live Com. K. Ragavendran.

EDITORIAL - BHARTIYA POST JULY 2010

SAVE POSTAL & ITS WORKERS

The Clarian Call has given to go for indefinite strike from 13.07.2010 to resist the policy offensives, anti worker policies, total unilateralism and non consultation of Staff Side even on staff matters, non filling up of vacant posts, non consideration of cadre reviews etc. Our sincere, continuous persuasions through dialogue to mitigate the issues confronting the Postal workers are taken as no relevance and construed as our weakness. We have been forced to launch this indefinite strike programme to save Postal, RMS and also the staff from the exploitation and policy offensives of the Govt.

History and events have proved in the past that the desire of neglecting the union and collective bargaining and exert total authority and unilateralism do not succeed. Trade Unions have a hoary history ever before the May Day and the martyrs of Chicago. It came into existence against all odds, have sustained all offensives and have succeeded in ensuring that workers never relent or retreat in spite of ruthless repression.

In the name of Project Arrow, the employees at grass root level are being tortured, exploited even beyond imagination. The efficiency in service can be arrived only by providing adequate man power and simplifying the procedures. Many new business and tie ups are introduced but withdrawn subsequently. The withdrawal of Flight services for carrying mails is the testimony about the faulty decision resulting loss to the department for which no contributory negligence provisions are available against the decision taken authorities. It is only to the employees working at the base. Even for bonus drawal to GDS, the same higher ups are causing orders to recover from the DDOs & SPOs in case of over drawal.

The buildings already renovated under earlier schemes are now brought under the Project Arrow. Lakhs of rupees are being spent and swindled. The funds allotted for staff quarters are being utilized by the circle heads to beautify their quarters. Many Chief PMGs are misusing the funds allotments resulting with no maintenance work to the staff quarters. Many of them have never seen colour washing over years.

It is evident that the huge costs of the services are primarily due to the faults of the management. However the blame is conveniently shifted to the shoulders of the employees and they are squeezed to enforce economy by orders of banning creation of posts, justified denial of overtime, incentive, denial of due promotions and officiating pay, abolition of section, sorting offices in RMS, curtailment of delivery, closure of post offices etc. Savings at the cost of the employees and squandering colossal amount by the faulty management is the order of the day. As responsible trade union, we must resist this kind of policy offensives unleashed by the authorities.

The 13th July 2010 strike is aiming not only to wrest our demands like filling up of posts, cadre review etc but also against the policy offensives like closure of Pos, privatization of Postal Services, closure of RMS offices etc.

The Nail must be hit on the head not at the bottom end. By showing our full strength with full mobilization, we can resist such moves of the department and save the Postal Service as Public service. The pertinent question before us is nothing other than the following.

Are we being driven to the brink or to the wall?
Have we not reached the end of the Tether?
Has the last straw been loaded on the camel?
Shall we not rise like a Tempest, Tidal wave or Tornado?

To wrest our just demands and fundamental rights and honorable too.
Let us organize the 13th July Strike with full vigor, determination and make it a grant success to save the Postal and its workers.

Brief Note containing suggestions/comments on the “Background Note on need for Review of Disciplinary Proceedings”, circulated under Department of personnel and Training, Letter D.O. No. 372/3/2007-AVD-III dated 19.05.2010

Introduction:
1. It appears that the letter and “Background Note” attached there with is intended to secure as many view points and suggestions as possible mainly to help formulation of necessary rules and regulations the stipulate specific time frame for finalizing the Disciplinary Proceedings both “Major” and Minor”. Reducing the number of Major Penalty proceedings and re-furbishing of the existing administrative machinery so as to equip it with adequate measures/instruments to achieve the goal of reduction in the overall quantum of Disciplinary Proceedings, is also intended in the Note.

Existing Time Frame:

2. It is not fully correct that “existing procedures do not prescribe any time limit for completion of the process for imposing penalty. Sub rule (4)(7)(11) and (12) of Rule 14 and sub rule (2) of rule 15 of CCS (CCA) Rules are specific about the time allowed to the charged Government servant at various stages, commending from submission of his written statement of defence to submission of the written representation on the Inquiry Report. But the relevant sub rules in Rule 14 and 15 ibid are silent about the time frame prescribed for completion of the following procedures: -

Rule – 14
(i) Sub rule (3) Framing and issuance of Charge Memo to the charged Government Servant (CGS)
(ii) Sub rule (5) Appointment of the Inquiry Authority (1.A) and Presenting Officer (P.O)
(iii) Sub rule (6) Forwarding of the Charge Memo and other documents to the I.A.
(iv) Sub rule (12) Production of additional documents requisitioned
& (13)
(v) Sub rule (19) Submission of Written Brief of arguments by both P.O. and CGS.
(vi) Sub rule (23) Submission of the Report by I.A.

Rule 15
(i) Sub rule (1) Remitting the case for further inquiry
(ii) Sub rule (2) Forwarding report of inquiry to the CGS
(iii) Sub rule (2-A) Issuing final orders
(3) and (4)

This position enables both the Inquiry Authority and Disciplinary Authority, to procrastinate their action/decision as prescribed in these procedural sub rules of rule – 14 and 15 ibid. Though there are umpteen number of executive orders and administrative instructions prescribing time frame for each procedure, as shown in para 3 of the Background Note, these are observed in practice, only in by-passing them stating many excuses/reasons. The suggestion, therefore, is to embody the time frame for each procedure prescribed in various sub rules of Rule 14, 15 and 16 ibid in the basic rule itself by suitably amending the same. Insertion of Sub rules (6) and (7) of Rule – 10 (Suspension) and resultant salutary effect of the same is the good precedent that can be recommended to favour the suggested amendment.

3. Simillary Rule 25 of the CCS (CCA) Rules 1965 stipulate the period do limitation of Appeal. But no time limit of consideration and disposal of Appeals is stipulated in Rule 27 ibid. The Government of India’s decisions issued in this behalf do not in any way help to ensure final disposal of an appeal, within prescribed time limit. Inordinate delay in disposal of appeals against suspension defeat the very same purpose of Appeal. The suggestion, therefore, is to embody the specific time frame for consideration and disposal of Appeals in Rule 27 ibid by suitably amending the Rule so that the claim of Appellant is upheld in case the appeal is not considered and disposed within the stipulated time frame.

CVC Consultation:
4. The proposal for reducing CVC consultation from two stages to single stage is a welcome measure. However, it may be mentioned here that this may not cause much difference in the overall quantum of disciplinary cases in view of the position that CVC consultation is now compulsory in respect of cases involving Group ‘A’ officers. What is required is to make it incumbent upon the Disciplinary Authority to issue the charge memo within the specified time frame of its decision to proceed against a Government Servant, for offences primafacie revealed in the preliminary investigation/report. This is possible by suitably amending sub rules (2) and (3) of Rule 14 ibid.

Revamping of the Structure of Penalties:
5. The proposal to re-structure, the existing three penalties prescribed in Rule 11(iii) (a), (iv) and (v) into that of one minor penalty viz. “Withholding of increment of pay upto a period of five years” is, of course a Welcome measure. However the provision of sub rule (1-A) of Rule – 16 ibid should continue to exist, in cases where the withholding of increments beyond a maximum period of three years, is ordered. Also the purpose of the proposed amendment , as given in the Note below item (iv) under “Minor Penalties”, must also find a place in the amended rule.

6. The proposal to delete the penalty prescribed in item (vii) of Rule 11 of the CCS (CCA) Rules – 1965 ie. The penalty of “Compulsory Retirement”, appears to have not formulated after the required indepth study. Availability of FR 56(j) for dealing with the inefficient employees cannot be relied on as a reason for delete the penalty of Compulsory retirement. Public interest is the main ground for invoking the provisions of FR 56 (j). It is purely an administrative decision. It is obviously not a judicial or quasi-judicial decision. An order of compulsory retirement simplicitor under FR 56(j) is not a penalty and does not attract the provisions of Article 311 of the Constitution. The decision to award the penalty of “Compulsory Retirement” is arrived at after completion of the prescribed procedure in a major penalty proceedings in cases where awarding of either of the extreme, penalties of ‘Dismissal’ and ‘Removal’ is considered very severe and disproportionate to the offence committed. In such cases the Disciplinary Authority/Appellate Authority, however, considers his further retention in service is against the interest of service but forfeiture of his past service, by which he is deprived of his due pensionary benefits, for the past service is considered as severe, and disproportionate. It is also to be noted that “a Government Servant compulsorily retired as a penalty may be granted pension or gratuity or both, at a reduced rate and if such cut is imposed on such pension he is not entitled for leave encashment. Thus this penalty prescribed has much scope in imposing a appropriate penalty, on a Government servant who has long years of unblemished service at his credit, but the proved offences against him in the current disciplinary proceedings are grave enough that this continued retention in service is against the interests of service. At the same time, forfeiture of his past service for such an offence would be severe and disproportionate. These are the circumstances and justification for awarding this penalty. The suggestion, therefore, is to retain this penalty. To overcome the possible misuse and undue advantages availed, invoking the provisions for “Cut in Pension” and also introducing a limit for left over service period by which imposition of this penalty in the case of Government Servants who has less than three or five years service left over, becomes invalid. Square elimination of this penalty will be against the principles of justice and fair play.

Other Administrative measures:
7. All other administrative measures proposed to complete speedy finalization of disciplinary cases, such as entrusting more number of cases to willing officers, increase in the amount of honorarium, maintaining of a centralized Data base etc. are welcome measures. But effective implementation of all these proposals can be gained only if accountability is enforced at all levels.

NEW TEAM OF OFFICE BEARERS LED BY THE SECRETARY GENERAL COMRADE M.KRISHNAN ALONG WITH ALL GENERAL SECRETARIES OF AFFILIATED UNIONS AND THE OUTGOING SECRETARY GENERAL COMRADE K.RAGAVENDRAN MET THE HIGHER OFFICERS OF POSTAL BOARD ON 24.06.2010
 
Dear Comrades - On successful completion of the 8th Federal Council Session of NFPE the team of new Office Bearers visited the Postal Directorate and submitted the list of newly elected office bearers to the Administration. Comrade K.Ragavendran introduced the new team to the Postal Board Members.  
 
The team was led by the newly elected Secretary General Comrade M.Krishnan and accompanied by Comrades K.V.Sridhran General Secretary P3; Ishwar Singh Dabas General Secretary P4; Giriraj Singh General Secretary R3; P.Suresh General Secretary R4; P.Rajanayagam General Secretary Postal Accounts; and R.N.Parashar Assistant Secretary General. 
Since the Secretary Posts was abroad, the NFPE team met the other Postal Services Board Members. Member [Technology] Shri.S.Samant assured consideration of the existing System Administrators whilt the project of technology wing is taken up in the coming months. Member [T] greted the new team for all success. 
 
 Member [P] Ms.Indira Krishnakumar assured to hold a special half a day meeting during second half of July on issues pertaining to Member [P] control. MACP; RR Rules for MSE; Shortage of staff; casual labourers wages from 1.1.2006 etc were highlighted during the discussion. Member [P] assured to look into our contention that the vacancies which are manned even for one day by a LR or OTA etc should not be deemed as abolished. Member [P] agreed to consider our view point. Member [P] greeted the success of the new team of NFPE office bearers.

COM. M. KRISHNAN, OUR CHQ PRESIDENT ASSUMES AS SECRETARY GENERAL, NFPE


Com. M. Krishnan, Our CHQ President has been elected unanimously as the Secretary General of National Federation of Postal employees in the Federal Council held at New Delhi from 20.06.2010 to 22.06.2010. We are happy about his election.

Com. M. Krishnan is every inch a self made leader who by sheer dint of determined dour and dogged work has risen to the top most position of Secretary General of the Federation. His characteristic qualities, the outlook and approach about the working class has made him elevated to this greatest position.

We expect that his leadership will give a dynamic direction to the activities of the organisation. We wish him success in all his tasks and also assured our fullest cooperation.

EIGHTH FEDERAL COUNCIL – A RESOUNDING SUCCESS

The Eighth Federal Council of the NFPE was held in New Delhi from 20.06.2010 to 22.06.2010 under the Presidentship of Com. D. K. Rahate, President NFPE. Dr. M. K. Pande, National vice President of CITU inaugurated the Federal Council on 20.06.2010 morning inaugural session.

The other prominent speakers in the inaugural session were comrades K. K. N. Kutty, Secretary General, Confederation, C. C. Pillai, Former Secretary General NFPE, P. Abimanyu, General Secretary BSNEU, M. S. Raja, Secretary General, All India Audit and Accounts Association, Vrigu Bhattacharjee, Secretary General, All India Civil Accounts Association, S. S. Mahadevaiah, General Secretary, AIPEDE Union, R. L. Bhattacharjee, Ex-Deputy Secretary General, NFPE, B. G. Tamhankar, Former NFPE President, Desraj Sharma, Ex- General Secretary P4, Shib Shankar Roy, Ex-AGS P3, Shankar Kaduskar, Ex-Vice President, P3 CHQ.

The Federal Council dealt a huge agenda and more than 35 Federal Councillers were allowed to discuss and debate on all the items of agenda. On 21.06.2010, our CHQ has launched the new edition of ‘Venture’ and the first copy was presented to Com. M. Krishnan, CHQ President by Com. C. C. Pillai, Ex-Secretary General, NFPE. Similarly another book ‘The Guide’ which was also compiled by our General Secrtary Com. K. V. Sridharan was released by P4 CHQ and the first copy was presented to Com. S. K. Humayun, CHQ President P4 CHQ by Com. C. C. Pillai. The release of two valuable books is perhaps one of the high lights of the Federal council.

After debates and discussions several resolutions were unanimously adopted and those resolutions will be published in the Postal crusader by the Federation. The Federal Council endorsed the strike decision and appealed all the Postal workers to make it all resounding success and mitigate the issues. The Federal Council further appealed all the Postal Workers to contribute Rs.100/- per head to NFPE for having a own building in the head quarters in the near future

A felicitation function was also organised to record the dedicated service rendered by Com. K. Ragavendran, as Secretary General to the Federation as he has to be relieved due to his superannuation on 30.06.2010. All senior leaders and General Secretaries were hailed the services of Com. K. Ragavendran.

On 22.06.2010 forenoon. Dr. Udai Balakrishnan, Member PLI delivered a beautiful oration about the services and the needs to protect the interest of Postal workers. His lecture is one of the master piece and his comradeship is highly laudable.

LAUNCHING “VENTURE” – SECOND EDITION
We are glad to inform that second edition of ‘Venture’ will be launched in the Federal council on 21.06.2010 at New Delhi.

It contains 12 chapters with 640 pages. We took all pain to update the Venture with all latest orders and it is our unique privilege to launch the Venture during the eighth Federal Council.

The cost of the Venture has been fixed as Rs.175/- only with our plan of ‘no profit, no loss’. Indent can be placed now onwards to the CHQ. It will be sent only by Regd. Post for which one has to pay Rs.30/- per copy towards postage charges.

All Branches/Divisional Secretaries are requested to furnish their demand about the number of copies required for their branches immediately by e-mail so that, it will be sent through registered post. Please treat this as urgent and important.

FLASH NEWS - RAILWAYS COMPLETES CADRE RESTRUCTURING AFTER 6th CPC

 

RAILWAYS COMPLETES CADRE RESTRUCTURING

DISCUSSIONS WITH UNIONS

Dear Comrades - Postal Department has not come forward to even constitute a Joint Committee of Official and Staff Side Members to go into the proposals of cadre restructuring - But the Railways once again completed their cadre restructuring after 6th CPC implementation - The new proposals finalised by Railway Authorities and Railway Staff Side is given below for information.

As per the new proposals, the Railway Commercial Clerks whose entry level scale of pay PB-1 with GP 2000/- will go up to 4600/- GP in PB-2 on percentage basis. The cadre restructuring will place only 14% of Clerks in the entry level and   24% will be in next level of 2400 GP; next 44% will jump to 4200 GP; and the balance 18% will go over to 4600 GP in PB-2.

Take the case of Ticket Checking Staff in Railways who are on par with our LDC. These sections will be placed from the entry scale of 1900 GP to 4600 GP in PB-2 at the percentage of 14%:24%:44%:18%. This means through cadre restructuring the LDC level officials also go up to 4600/- GP in PB-2 in Railways.

If Railways Cadre Restructuring can go up to 4600/- for officials with starting GP 1900- and 2000/- then why not Postal Assitants with entry GP 2400/- cannot go up to 4800/- through cadre Restructuring? Why the Postmen with 2000/- entry GP and LDCs with 1900/- GP in Department of Posts cannot go up to 4600/- GP like Railways?

The 8th Federal Council is being held in the National Capital from 2oth to 22nd June, 2010.

We the P3 are the biggest organisation amongst the affiliates of NFPE.
We have a major role to play for the success of our Federation's biggest event, the Federal Council. The complete success of Federal Council will strengthen the Federation and that will directly strengthen our own P3 Organisation by leaps and bounds.
The Federal Secretariat had taken a decision to hold it in headquarters and manage the entire expenses of the Federal Council through collection of advertisements for the Sourvenir. We have appealed to all Circle /Divisional / Branch Secretaries to at least send one Advertisement from each Division / Branch Union.

CAMPAIGN MATERIAL ON THE 17 POINT CHARTER OF DEMANDS OF POSTAL JCA

Serve the Strike Notice at all levels on 4.6.2010 jointly by all Unions of Postal JCA when the All India Postal JCA of NFPE - FNPO - AIPEDEU - NUGDS will be serving the Notice on the Department of Posts.
 
 

1.       Drop the move to outsource any function of the DoP including on the recommendations of McKinsey – Cancel the decision to close down 'C' Class Post Offices – Cancel the orders for down gradation of EDSOs into ED BOs  and closure of EDBOs - Roll back steps of privatisation of speed post processing and mail conveyance and data entry work.

 

The decision of the Postal Board to summarily close down maximum single handed urban TSOs is most retrograde and against to the interest of service.  It is nothing but a ruse mentioning the matter of convenience of taking leave by the officials as claimed by the department behind this move but withdrawal of postal services in the existing post offices is aimed in order to outsource the operations through franchisees.  The orders on down-gradation of all GDS SOs into GDS BOs and closures of GDS BOs with the neighbouring Departmental TSOs are other retrograde steps with the ulterior motive for the introduction of more franchisee outlets. These steps will result in withdrawal of services to public and also cause adverse impact on staff interests. The Circle Administration here and there commenced operations to privatize the processing of speed post articles and outsource the mail conveyance and data entry work. The outsourcing and privatizing of postal operations is a negative step and huge revenue of the department is being diverted to private concerns. All these retrograde steps are to be rolled back by the Department. 

 

2.       Stop violations in the Agreements on Status Quo of RMS & MMS as well as the merger of RMS with less than 10,000 mails – Create scientific norms for the work in CRC, Speed Post, Logistics and EPP – Cancel the orders for replacing the General Line HSG-I by ASPOs in Mail Offices.

 

Despite agreements reached between the Department and the Staff Side, the Circle Administration in different circles are taking the liberty to close down RMS Offices and transfer headquarters with men and material  in violation of the agreements. The attempts of Maharashtra Circle Administration to merge different RMS Offices with more than 10,000 letter mail volume and thus disturbing the status quo agreed to by the Department on 30th November high level discussions is an example. The Administration in total violation of the Statutory Rules is replacing the HSG-I General Line officials with the ASPOs based on some discussions and decisions taken in the workshop held at Bangalore among the officers and without any discussions with the staff side. These violations of agreements and statutory rules are to be rolled back immediately. The earlier agreement arrived with staff side to keep the mail offices with 10000 letter mails per day should be honoured in true spirit.

 

3.       Holding of JCM Departmental Council meetings; Periodical Meetings with Federations; Sending of the issue of discrimination of pay scales between the Telecom TBOP/BCR and Postal TBOP/BCR w.e.f. 1.1.1996 to Board of Arbitration; and Holding of GDS Committee Meetings periodically with GDS Unions.

 

Despite reconstitution of Departmental Council JCM and submission of subjects by the Staff Side, no meeting of JCM Departmental Council is being convened. This negotiating forum has been locked up for years together and that is undermining the very basis of joint consultations on staff issues and unilateral implementation of several retrograde orders taking place. Similarly no Periodical Meeting with the Federations and All India Unions are taking place for a very long time and no such meeting has been convened despite recognition granted to the Federations. Similarly the holding of GDS Committee meetings has never re-commenced for a very long time which denies the only opportunity of negotiations to the GDS cadre on their genuine issues.  Even the meeting of Departmental Anomaly Committee that has met once in which the staff side insisted for parity of pay scales between the Telecom TBOP/BCR and Postal TBOP/BCR w.e.f. 1.1.1996 but the Official side has not even recorded any disagreement on that issue for referring to arbitration. All these fora of negotiations should commence regular meetings and the issue of pay parity with Telecom should go for arbitration.

 

4.       Stop harassment of staff under Project Arrow – No extraction of work against Rules – No extraction of work beyond 8 Hours – No drafting of staff on duty and for Training etc on Sundays and Holidays – No harassment in the name of 100% Delivery – Withdrawal of all Punishments awarded to Postmen for minor non-delivery of articles.

 

In the Project Arrow Offices the staffs are being harassed to violate Manuals of Department but all such orders are kept as oral orders. The Staff side insists that all orders with regard to the functioning of the Project Arrow should be issued in writing by the Officers and no staff should be forced to implement oral orders of officers. There shall be no extraction of work against the Departmental Rules. The harassment against Postmen for 100% delivery should be stopped forthwith as 100% delivery is humanly impossible without violating Rules. There should be no drafting of Staff for training or duty on Sundays and Holidays without compensatory off and monetary compensation as well as expenses towards travelling etc. The full complementary strength as per blue book instructions should be maintained in Project Arrow Offices for which measurers like exclusive leave reserve staff for such offices shall be stationed without disturbing the actual strength of other offices. Punishments awarded for short of 100% delivery should be withdrawn immediately and Officers at all levels are to be instructed not to be vindictive. The unilateral extension of counter hours without providing staff and harassing the staff to look after the additional work without any compensation should be dispensed with. Ordering the officials to attend all Sundays and holidays without any off or weekly holidays to complete the pending work for core banking solutions should be stopped forthwith. The ILO norms on weekly holidays should be honoured.

 

5.       Fill up all vacant posts: [a] Undertake reassessment of vacancies in PA/SA cadre to rectify mistaken calculation of vacancies in all circles; [b] Fill up all vacant posts in all cadres in Department of Posts [Postal, RMS, MMS, Admn, DPLI, Postal Accounts, SBCO, Civil Wing etc] as on 31.12.2009; [c] Allow local recruitment as one time measure in Postal Accounts similar to 1997 at Sundernagar. 

 

There are large numbers of vacancies unfilled even now in different cadres. There were grave calculation errors in almost all the circles in assessing the vacancies of PA/SA cadre resulting more than 30 to 40% vacancies in the sanctioned establishment posts. The vacancies occurred due to LSG promotions were not taken as vacancies of those particular years. The vacancies kept under residual vacancies are not filled up and more than 5000 PA/SA vacancies are still kept unfilled under this category. This error should be rectified by causing reassessment of vacancies in all circles  duly taking all the unfilled up vacancies in the establishment register and roll of the divisions as on 31.12.2009 as current year vacancies for 2009 and filled up the same in a time bound manner. As far as the Postal Accounts is concerned, local recruitment similar to 1997 recruitment at Sundernagar has to be permitted as one-time measure to come out from the heavy shortage of staff prevailing there. All vacant posts in all cadres of PA/SA postal; PA/SA RMS; Drivers and Workshop staff in MMS; PA CO in CO/RO/DPLI; PA SBCO; Postman/Mailguards/Multi Task Staff; and Civil Wing Ministerial and Technical should be filled up.

 

6.       Comprehensive Cadre Restructuring of Group 'C' employees in PA/SA Cadre; [b] Withdrawal of unilateral orders on piecemeal cadre restructuring of Postmasters' cadre until comprehensive Cadre Restructuring of PA/SA cadre is completed; [c] Comprehensive Cadre Restructuring of LDC, Sorters & DEOs in Postal Accounts by amalgamation into a single Accounts Assistants cadre in the pay of Pb-1 with 2400 GP; [d] Comprehensive Cadre restructuring in PA CO cadre in CO/RO/DPLI; [e] Comprehensive cadre Restructuring of PA/SA cadre in SBCO; and [f] Comprehensive cadre restructuring of Postmen/Mailguard/Multi Task Staff.

 

Proposals for comprehensive cadre restructuring of all cadres in Postal Department was submitted immediately after the formal meeting held by the Secretary [P] on 13.01.2009  but even after one year and five months, no action has been initiated so far in this matter. The cadre restructuring in other CG Departments like Income Tax and Railways are gone to final stages. Unfortunately, the Department instead of going into comprehensive cadre restructuring of Group 'C' officials, has preferred to unilaterally restructure the 'Postmasters' cadre' distorting the existing promotional structure on the face of staff side objections. We demand immediate measures to comprehensively restructure all the cadres in the Department of Posts including the PA/SA in Postal and RMS/MMS, the Postal Accounts, Circle Offices, DPLI, SBCO, Postmen/Mailguards, Multi Task Staff.

 

7.       Grant of Pension, Departmental status to GDS extending the all benefits such as HRA/CCA, ACP etc, including Trade Union rights and welfare measurers – Remove discrimination on Bonus ceiling – Modify the 20,000 unilateral imposition of cash handling work points for GDS BPMs – Withdraw orders denying revised TRCA w.e.f. 1.1.2006 in respect of BPMs – Compute work norms to all types of work performed including NREGS, PLI,RPLI, Pension Payments etc to GDS – Implement enhanced Social Security to GDS like Ex-Gratia Gratuity and Severance Amount w.e.f. 1.1.2006.

 

Retirement benefits like ex-gratia and severance amount which were enhanced as recommended by the GDS Committee should be paid w.e.f. 1.1.2006 since all retirement benefits to regular employees on the recommendations of 6th CPC were implemented not from a prospective date but from 1.1.2006. Comprehensive schemes for departmentalisation of GDS by allocating proper work norms for PLI/RPLI, NREGS, Pension MOs and Bill Payments etc to enhance the work hours of GDS for facilitating departmentalisation should be worked out. Now with the large scale of expansion of PLI/RPLI as well as NREGS work coming up in a big way, there shall be change of approach towards GDS System to comprehensively departmentalise them. Grant of Pension, Grant of all benefits, Grant of Trade Union facilities, Grant of Welfare measurers etc to GDS shall be considered. The discrimination perpetrated in the name of GDS Committee to deny the parity on the matter of PLB Ceiling of 3500/- should be removed.  The unscientific tightening of BPM work norms by enhancing the quantum of cash handling to 20,000/- per point should be modified.

 

8.       Grant of Parity in Pay Scale [PB-1 with GP 2400/-] for MMS Drivers on par with Drivers of Parliament Secretariat – Recruitment of adequate number of Drivers – Sanction of OSA for the long distance logistics van drivers of MMS – Technology training to Work Shop staff and grant of Data Entry Operators scale of pay to Work Shop Staff.

 

The Drivers in MMS are to be granted PB-1 with GP 2400/- on par with the Drivers of Parliament Secretariat and all vacancies of Drivers shall be filled up immediately taking into account of total mail vans including the new vans purchased. The Drivers engaged in long distance logistics vans shall be granted with OSA. The Work shop staffs are to be imparted with the technology training and since they are involved in operations of computers for maintenance of modern power vehicles, they should be granted with the pay scale of PB-1 with 2400/- GP. There should be a system of third party insurance for Government vehicles also to off-set the liability of recovery of compensation from the Drivers on accidents.

 

9.       Implement Supreme Court Orders for revision of wages from 1.1.2006 [6th CPC wages] to all RRR Candidates, Casual Labourers, Contingent staff, GDS Substitutes etc – Grant Temporary Status to eligible Full Time Status Casual labourers; Convert Part Time into Full Time; Absorb Full Time, Part Time, contingent in vacant GDS Posts.

 

All Casual labourers other than those conferred with Temporary Status are to be granted refixation of wages on the basis of minimum wages granted by the 6th CPC for corresponding category of staff w.e.f. 1.1.2006. The non-fixation of revised wages by the Department of Posts is contrary to Apex Court Judgement and directions. The GDS substitutes also shall be refixed with their wages on par with the revised GDS Wages w.e.f. 1.1.2006. It is seen that several eligible full time casual labourers in Department of Posts for conferment of Temporary Status are denied the status; Part Time casual labourers are not converted into full time casual labourers wherever possible; no recruitment as GDS is taking place from amongst the casual labourers. The casual labourers of all types are to be comprehensively absorbed in to the main stream either by granting temporary status or by providing GDS appointments as one time measure.

 

10.   Fill up all vacancies of Postmen and Mailguards - Roll back the unscientific scheme of Single Postman Beat System – Modify certain unscientific work norms of Postmen / MTS finalised by Work Study Unit - Enhance the Postman Double Duty Allowance as per the recommendations of 6th CPC.

 

All vacancies of Postmen/Mailguards are to be filled up immediately. The unscientific insistence for conversion of double postmen beats into single postman beats should be stopped and reversed and at least blind insistence of single beat system in metro cities should be dropped in order to maintain efficiency and to compete the couriers. The work norms finalised by the department on the recommendations of Work Study Unit is unscientific in some areas, like delivery of ordinary letters; delivery of CD Articles etc. There is no time factor allotted for delivering 'Intimations' to addressees. There is no limit prescribed for the maximum distance of a Postman beat which is leading to construction of very lengthy beats for more than 50 kilometres, which is unscientific and humanly impossible. The double duty allowance payable to Postmen cannot be construed as overtime allowance but should be equated to at least to a minimum of a postman specific allowance paid for looking after the entire work of the absentee postmen. This allowance has to be enhanced by delinking this allowance from the concept of OTA.

 

11.   Remove all local anomalies in MACP Scheme like application of benchmark for the period prior to introduction of MACP Scheme; Grant MACP on 'Average' benchmark like Department of Railways; Denial of MACP for acts of denial of regular promotion earlier to introduction of MACP; Denial to grant PB-2 while upgradation to Grade Pay 4200 and above to Group 'C' Officials etc.

 

MACP scheme is introduced in department of posts with several local anomalies. Prior to introduction of MACP scheme we were covered under the TBOP/BCR Scheme in which the question of 'benchmark' did not exist for grant of promotion or upgradation. Therefore the 'benchmark' should not be applied for the earlier years prior to introduction of MACP scheme. Moreover we find that the Railways have granted MACP on 'average' benchmark only. Similarly in the earlier system of TBOP/BCR, declination of regular promotion did not affect grant of TBOP/BCR and therefore the declination of regular promotion if any by officials in the past shall not be taken against grant of MACP for the past years before introduction of MACP. The Departmental orders on MACP wrongly denied PB-2 even when officials are to be upgraded into 4200/- GP and this mistake should be rectified by appropriate corrigendum. There are several queries raised and wrong implementation resorted to in many circles and therefore a comprehensive clarificatory instruction from Directorate with appropriate illustrations should be issued.

 

12.   Creation of System Administrators Cadre with higher pay scales and absorption of all System Administrators in the new cadre during initial composition – Uniform Norms for System Administrators including work hours, number of systems, distance factor – Financial compensation for special and extra work performed by System Administrators.

 

There are approximately more than 2000 System Administrators working in Department of Posts without any such cadre creation. Their work is above the work of data entry operators. Either their work is comparable to System Engineers or to Data Processing Assistants or hence they should be a separate cadre with higher pay scales. A separate cadre should be created forthwith duly considering the cadre restructuring proposals submitted by the Group C unions and the existing systems administrators should be absorbed in the newly elevated creation posts by conducting a simple trade test. There are no uniform norms for their work, work hours, attendance etc. Their work should be codified with number of systems as well as distance factor uniformly. Additional financial compensation for special and extra work they put in shall be provided for.

 

13.   Early finalisation of Recruitment Rules for upgraded Group 'C' in PB-1 with 1800 GP – Ensure present system of absorption of GDS and TS CLS in Group 'D' posts into the new RR without insisting for the educational qualification – Filling up all the posts of Multi Tasking Staff without any delay.

 

The Recruitment Rules for upgraded Group 'C' in PB-1 with GP 1800 is yet to be released in Department of Posts even after the model RR released by the DOPT. It should be ensured that the present system of recruitment into the cadre of Group 'D' from amongst the GDS and TS CLs on 75:25 basis without any condition on minimum educational qualifications  should continue. These sections have been adversely affected due to large scale abolition of Group D vacancies in the recent past. Early finalisation of RR and commencement of recruitment should be ordered.

 

14.   Amalgamation of Group 'C' Accounts Cadres of DoP and DoT.

 

The DoP and DoT Accounts have been merged but this merger has been restricted to Group 'B' and above cadres only. The Committee headed by Chief PMG Delhi Circle Shri.Ragahvlal had recommended that the merger of Group 'C' cadre of DoP and DoT should follow some time later than the merger of Group 'B'. Action may be initiated for merger of Group 'C' Accounts Cadre also.

 

 

15.   Roll back of the Decentralisation of PLI/RPLI work – Augment required staff strength in PLI branch of CO/RO/DPLI –Maintain centralized accounting system through the Office of DPLI Kolkata – Fill up the vacant posts of COs/ROs/DPLI Kolkata to manage huge shortage;

In the background of technology introduction in the field of PLI/RPLI and its further modernisation, we suggest that there is no need for decentralised work in PLI/PRLI to avoid duplication of work. Due to heavy shortage in operative offices and divisions, the arrangement of extracting the work of PLI/RPLI from the field staff without augmenting their strength is causing difficulties. It is better to augment the PLI Branches of CO/RO to the minimum level and centralise the work in CO/RO with modern technology for better efficiency and customer satisfaction. The accounting system should be centralised and maintained through the Office of DPLI Kolkata. Simultaneously all vacant posts in CO/RO/DPLI should be filled up without further delay.

 

16.   Parity of scale of pay of Ministerial Cadre in Postal Civil Wing on par with the Postal Assistants and upgradation of posts of Works Clerk Grade –II/Grade-I/Head Clerk – Filling up of all vacant posts of technical as well as ministerial posts – Creation of one Civil Wing Circle for each Postal Circle.

 

The Ministerial cadre in Postal Civil Wing may be restructured on par with the Postal Assistants. The posts of Works Clerk Grade-II/Grade-I/Head Clerk shall be upgraded. All vacant posts in both technical and ministerial posts in civil wing shall be immediately filled up. We urge for creation of Civil Wing Units for each Postal Circle instead of the present arrangement for better management of civil wing work.

 

17.   Regularise the HSG-I, HSG-II, LSG arrangements and grant Officiating Pay & Allowances to all Officials holding the posts.

 

Once an official is ordered to work in a post with higher responsibilities he/she should be paid the Pay of corresponding higher posts. The denial of officiating pay and allowances for officials who officiated against the HSG-I and HSG-II / LSG posts was struck down by the Courts. Still the officiating pay and allowances to such officials is not sanctioned and officials in HSGII and LSG were ordered to officiate in higher posts without any higher officiating pay. The cases referred by Tamilnadu circle and West Bengal with regard to grant of officiating pay for the past cases may decided favourably. Immediate orders for payment of higher pay and allowances should be issued by Directorate.

ORDERS ON MAINTAINING GRADATION LISTS OF MULTI-SKILLED EMPLOYEES

Dear Comrades - The Recruitment Rules of Multi-Skilled Employees are under preparation following the DOPT guidelines on Model Recruitment Rules for these catergories of emplloyees had been released. Taking into account of the different category of Group D employees existing in Department of Posts, it has been ordered to maintain inter-se seniority of erstwhile Group D according to their area of work viz., Post Offices, RMS Offices, Administrative Office etc and Division or Unit wise as at present. Sir/Madam,

In accordance with the provisions of Sub Section (1) of Section 22 of the Industrial Disputes Act, 1947, we hereby notify that all the Postal/RMS/MMS/Administrative & Postal Accounts Employees and the Gramin Dak Sewaks will go on indefinite strike from 13.07.2010. The demands for acceptance of which the employees embark upon this indefinite strike are detailed in the Charter of Demands enclosed.

CHARTER OF DEMANDS
 

 

1.       Drop the move to outsource any function of the DoP including on the recommendations of McKinsey – Cancel the decision to close down 'C' Class Post Offices – Cancel the orders for down gradation of EDSOs into ED BOs  and closure of EDBOs - Roll back steps of privatisation of speed post processing and mail conveyance and data entry work.

2.       Stop violations in the Agreements on Status Quo of RMS & MMS as well as the merger of RMS with less than 10,000 mails – Create scientific norms for the work in CRC, Speed Post, Logistics and EPP – Cancel the orders for replacing the General Line HSG-I by ASPOs in Mail Offices.

3.       Holding of JCM Departmental Council meetings; Periodical Meetings with Federations; Sending of the issue of discrimination of pay scales between the Telecom TBOP/BCR and Postal TBOP/BCR w.e.f. 1.1.1996 to Board of Arbitration; and Holding of GDS Committee Meetings periodically with GDS Unions.

4.       Stop harassment of staff under Project Arrow – No extraction of work against Rules – No extraction of work beyond 8 Hours – No drafting of staff on duty and for Training etc on Sundays and Holidays – No harassment in the name of 100% Delivery – Withdrawal of all Punishments awarded to Postmen for minor non-delivery of articles.

5.       Fill up all vacant posts: [a] Undertake reassessment of vacancies in PA/SA cadre to rectify mistaken calculation of vacancies in all circles; [b] Fill up all vacant posts in all cadres in Department of Posts [Postal, RMS, MMS, Admn, DPLI, Postal Accounts, SBCO, Civil Wing etc] as on 31.12.2009; [c] Allow local recruitment as one time measure in Postal Accounts similar to 1997 at Sundernagar. 

6.       Comprehensive Cadre Restructuring of Group 'C' employees in PA/SA Cadre; [b] Withdrawal of unilateral orders on piecemeal cadre restructuring of Postmasters' cadre until comprehensive Cadre Restructuring of PA/SA cadre is completed; [c] Comprehensive Cadre Restructuring of LDC, Sorters & DEOs in Postal Accounts by amalgamation into a single Accounts Assistants cadre in the pay of Pb-1 with 2400 GP; [d] Comprehensive Cadre restructuring in PA CO cadre in CO/RO/DPLI; [e] Comprehensive cadre Restructuring of PA/SA cadre in SBCO; and [f] Comprehensive cadre restructuring of Postmen/Mailguard/Multi Task Staff.

7.       Grant of Pension, Departmental status to GDS extending the all benefits such as HRA/CCA, ACP etc, including Trade Union rights and welfare measurers – Remove discrimination on Bonus ceiling – Modify the 20,000 unilateral imposition of cash handling work points for GDS BPMs – Withdraw orders denying revised TRCA w.e.f. 1.1.2006 in respect of BPMs – Compute work norms to all types of work performed including NREGS, PLI,RPLI, Pension Payments etc to GDS – Implement enhanced Social Security to GDS like Ex-Gratia Gratuity and Severance Amount w.e.f. 1.1.2006.

8.       Grant of Parity in Pay Scale [PB-1 with GP 2400/-] for MMS Drivers on par with Drivers of Parliament Secretariat – Recruitment of adequate number of Drivers – Sanction of OSA for the long distance logistics van drivers of MMS – Technology training to Work Shop staff and grant of Data Entry Operators scale of pay to Work Shop Staff.

9.       Implement Supreme Court Orders for revision of wages from 1.1.2006 [6th CPC wages] to all RRR Candidates, Casual Labourers, Contingent staff, GDS Substitutes etc – Grant Temporary Status to eligible Full Time Status Casual labourers; Convert Part Time into Full Time; Absorb Full Time, Part Time, contingent in vacant GDS Posts.

10.   Fill up all vacancies of Postmen and Mailguards - Roll back the unscientific scheme of Single Postman Beat System – Modify certain unscientific work norms of Postmen / MTS finalised by Work Study Unit - Enhance the Postman Double Duty Allowance as per the recommendations of 6th CPC.

11.   Remove all local anomalies in MACP Scheme like application of benchmark for the period prior to introduction of MACP Scheme; Grant MACP on 'Average' benchmark like Department of Railways; Denial of MACP for acts of denial of regular promotion earlier to introduction of MACP; Denial to grant PB-2 while upgradation to Grade Pay 4200 and above to Group 'C' Officials etc.

12.   Creation of System Administrators Cadre with higher pay scales and absorption of all System Administrators in the new cadre during initial composition – Uniform Norms for System Administrators including work hours, number of systems, distance factor – Financial compensation for special and extra work performed by System Administrators.

13.   Early finalisation of Recruitment Rules for upgraded Group 'C' in PB-1 with 1800 GP – Ensure present system of absorption of GDS and TS CLS in Group 'D' posts into the new RR without insisting for the educational qualification – Filling up all the posts of Multi Tasking Staff without any delay.

14.   Amalgamation of Group 'C' Accounts Cadres of DoP and DoT.

15.   Roll back of the Decentralisation of PLI/RPLI work – Augment required staff strength in PLI branch of CO/RO/DPLI –Maintain centralized accounting system through the Office of DPLI Kolkata – Fill up the vacant posts of COs/ROs/DPLI Kolkata to manage huge shortage;

16.   Parity of scale of pay of Ministerial Cadre in Postal Civil Wing on par with the Postal Assistants and upgradation of posts of Works Clerk Grade –II/Grade-I/Head Clerk – Filling up of all vacant posts of technical as well as ministerial posts – Creation of one Civil Wing Circle for each Postal Circle.

17.   Regularise the HSG-I, HSG-II, LSG arrangements and grant Officiating Pay & Allowances to all Officials holding the posts.
